This is an outline of a complaint sent to Ola Holidays, they did reply and in short said they were sorry but in actual fact they had booked the accomodation through Hotels4U- I've checked through ABTA who say this group are no longer ABTA members- is there anything I can do?

Please note, it is rare for me to complain about anything but I'm sure you'll agree this is exceptional.
At the time of booking I made sure I was booking for the Amaika Hotel, Callela, satisfied that after talking to your reps, reading various reviews and your company confirming in writing, that I wouldn't be letting myself or the other party members down with that choice- imagine how I felt when the taxi driver dropped us off at the Amaika and we got to the reception door to discover it locked and the whole hotel shut down!
We were stranded in the dark and without accommodation- that was the start.
After enquiring around with the locals a local man suggested we try for accommodation at the other hotels owned by HTop. I had stayed at the Olympic 2 years ago and vowed never to return so, prominent with its neon glo was the Calalla palace, enquiries with the staff there confirmed the Amaika was closed but they have our details because of being owned by the same group- we reluctantly made the decision to stay there and as it turned out on reflection would have much rather have stayed at the Olympic!
It was awful, it had the same food and paper thin walls as the Olympic. I had to make numerous representations to the hotels reception, the worst thing being cigarette smoke filtering into our room from a source the hotel could not identify, despite their assurances as to their policy for smoking and smoke alarms that should have signaled a problem here. The smell of stale tobacco was so bad that all of us in the party had problems sleeping and all of our clothing became contaminated. The hotel could not move us as they said they had no spare rooms. The smell had the effect of ‘burning' our nostrils. Lack of sleep was a particular issue to myself. Coupled with the fact you could hear every intimate detail of noise from the next room and the smell of tobacco, I had arranged the short holiday as a get away after having surgery for cancer so I can tell you I couldn't wait to get home and get some sleep. At this point I shall refrain from talking about all other issues as these are already documented on the various review forums on the web, but needless to say we should not have had the discomfort of any of those issues if we had have stayed at the Amaika for which we were booked. Why was I not told of The Amaika being closed before we left? At least we would have had a choice in the matter.
Also ABTA is an Association of British Travel Agents. I do not see how this would stop your claim as you do not need to go via ABTA. Furthermore is ola holidays ABTA? I would get back in touch with Ola Holidays as you booked the holiday through them as it seems they are trying to pass the buck and wash their hands of it all.

did you call them to see if they could help.
if not, i fear you will get nowhere with this. HTOP have provided you with accomodation in a 4* hotel -the same * rating as the amaika, and only round the corner (not a patch on the amaika though).
it is well known on the costa brava forum that HTOP operate a rolling programme of closing their hotels in the area during the early part of the year, for staff holidays and to do repairs etc. and holidaymakers get moved at very short notice. i have had it happen to me.i doubt that the holiday companies knew about the close down before it happened.
note - HTOP ususally put a notice outside the hotel that is closed directing you to another hotel
i know that is no consolation,but if you had called the local contact you may have got a 4* hotel in another resort that would have been better than the calella palace.
