I would like some advice.
In Sept we booked a holiday to Cuba with direct holidays online for 17th July. We paid £60 deposit. From our understanding we had to pay a further installment of £180, 8 weeks after the booking in December and the remaining balance 8 weeks before departure.
In October I found out I was pregnant and the baby is due 1st of July so clearly I would not be travelling to Cuba on the 17th.
I am 90% sure I called Direct Holidays and cancelled the booking in October, I was really ill with extreme morning sickness and had a lot of other issues going on at the time so I can not be 100% certain.
Direct holidays say I did not call them.
Anyway we thought we had cancelled the holiday so did not pay the £180 installment in December and heard nothing from direct holidays and really thought no more about it.
Then today we got a letter from them asking for the balance. I telephoned and told them we had cancelled. And they said they have no record of the call but whether I have or not is irrelvent as if I want to cancel now or then I would be liable for £180 deposit.
I explained we had paid £60 deposit and we aware we had lost that. But the lady was adement that this £60 was not the deposit it was just part of it and we owe a further £90 per person, hence £180. She said I had agreed ro these terms and conditions.
I have not signed anything.
Do I have to pay this money?
It seems that strange hey can turn round and say that the £60 was not a deposit and we have to pay fthem for cancelling. Surely they should have persued this £180 back in Dec when it was due. I would have thought it was reasonable to assume that all was fine with the cancellation and the booking had expired as I had not heard from them till now.

Secondly, as with all "low deposit" schemes, in the event of cancellation the full deposit is payable. It should've been somewhere in the small print.

So the onus was not on them to chase it up 8 weeks after the orginal booking when it was due?
As far as I understand, it is still a debt you owe to the Company. Whether they choose to chase the debt is irrelevant.
Do you have any idea if we do pay it will we be able to claim it back from holiday insurance.
We have travel insurance through the police federation.
I would check the policy wording but I would have thought that you can claim it back (less any excess).

This is not a response to your query but just wanted to say congratulations on your pregnancy.
I agree with the advice you've been given here. You are responsible for the debt of £180 as it was a low deposit you paid originally. However, you should be able to claim your deposit back minus the excess on your policy. You will probably need to produce doctor's evidence of your pregnancy. I hope you don't have too much of an excess on your insurance. Congrats on your pregnancy!
I called the insurance they said we are covered and they will remburse us, but there is a £50 per person excess.
Still think Direct holidays should make it much clearer that the low deposit is not infact the deposit! Think it is all a bit of a con.

Pleased you're getting something back from the insurance and hope all goes well with your pregnancy.
Unfortunately this is the way that low deposit schemes work. All tour ops are the same. Glad you 'll get some of it back and congratulations!
