Parador would have acted as agents for Polaris World, earning a commission for each property sold. You will not get a refund of your 600 Euro fee, and as they are no longer trading, you will not get the service that you paid for.
I cannot think of any Polaris site which is within walking distance from the sea. All of their developments are golf complexes. You could claim that you were mis-sold the property on this basis, but I find it quite unbelievable that you did not see the proposed area for your purchase until 2 years (and 66,000 Euro) after you paid a deposit and 600 Euro Owners Club fee. So asking for a return of your money for that reason would probably not meet with much success.
If you have been paying a Solicitor then it is up to him to get your money returned. Your contract should have a property completion date on it, and if that date has been passed, then you would be entitled to a full refund. Having said that, if you have paid your Solicitor the stage payments and he has passed them on to Polaris, then Polaris must have a record of his practice and the transactions. You may find that your Solicitor has not passed on your payments, in which case you can get your money back directly from him.
Polaris, to my knowledge, is now working with the very minimum of sales and administration staff and building on all their sites has been halted. If I were in your position I would act very quickly in trying to sort out the situation, as you would not want to be at the bottom of a very long list of creditors.
I cannot see you being liable for any more payments, but get professional legal advice"¦"¦QUICKLY!
HI the reason we did not see the property was that we only saw the model in their offices, because they had not started construction .The Isla had to be dug out first as we were told, then the golf course constructed .Even the administrator did not know how many people had been ripped off because as they told us Parador had not been keeping proper account of how many people have been invoved .They were basically sitting by the phone waiting for people to contact them because they dont know how many people it involves,so if you dont contact the administrator you wont have a claim .I blame POLARIS aswell because they must know ,all they have said to me is PARADOR are nothing to do with us ?? I would like to know how many more people have been missold at the ISLA CONDADA.
Without wishing to defend Parador in any way, it is not their fault that the property is not built, and they would not receive their full commission until completion.
I have no idea what administrator you might be talking about, but other than taking a fee for a now non-existent Owners Club, how can Parador have ripped off you or anyone else? You have a Polaris contract and if the property is still not completed within the specified timescale then your grievance should be with them. They are simply passing the buck by blaming an Agent.
The 66,000 Euro that you have paid to your Solicitor should have been paid to Polaris, and they would have exchanged that money for a bank guarantee certificate which your Solicitor should have. Parador haven't got your money, but either your Solicitor or Polaris have, and it is up to one of them to give it back to you.
As I previously stated, if you are paying a Solicitor, then get him to sort your problem out for you. Polaris will probably want to swap your intended purchase for one of their many unsold completed properties on another site. Alternatively, you can insist on a total refund. Either way you will be in a strong position to renegotiate, as the price of the property that you originally purchased would now have dropped considerably.
Just do a google for Parador, I shall say no more
The reason why we did not see the area was ,we originally went with my sister inlaw she was the one who was buying .On the second day she was not able to finance the purchase due to her husband not giving her the finance to buy.So on the third day with a lot of cohersion from the rep we went to POLARIS head office .We never saw the area because it wasnt what the sister inlaw had instructed the rep she required. But it so happened that the property was suitable for us.While we had gone around looking we talked about families etc, knowing we had only an hour or so before our flight back home she said why dont you have a look at our new development it will fit your criteria perfectly .So knowing our criteria we took her word and this is how we are in this mess
A bit niaive I thnk and Far too trusting. I think you sister inlaws husband was very wise not to give her the finance. NEVER NEVER BE RUSHED INTO A PURCHASE OF THIS MAGNITUDE. WOULD YOU BUY A PROPERTY IN THE UK LIKE THIS? OFF PLAN ? WITHOUT SEEING THE AREA ? I THINK NOT !!!
