I can't answer for Gumusluk im afraid, but here in Altinkum all our complexes are freehold.

Jenifer if its not freehold dont buy it full stop. If what you say is right and the military own the land there will not be any commercial building on -think about it if the military own the land and decide to level what ever is on it now -or in five years do you think you will get any recompense???

My company is an estate agency based in Altinkum but this advice should apply anywhere:

If the property you are looking to buy is in a military zone, you won't be able to buy it. Simple as that. Turkey does not allow foreigners to buy property in a military zone, so all purchases by foreigners are screened by the government before the deeds are released for transfer. Having said that, to the best of my knowledge Gumusluk isn't in a military zone - if it was, there would be no foreigners owning property there now!

Your apartment should be freehold. On a complex, this means that you have the right to do whatever you want with the inside, and you own a proportionate share of the common areas like gardens, pool etc.

When you go to sign your sales contract, you should take the opportunity to ask the solicitor questions like this - that is your right as a buyer and the solicitor is required to advise you on anything that could be a cause for concern. You can ask to modify the terms of sale, or pull out of the sale at this point if anything about the deal makes you unhappy. However you are still protected if you sign the sales contract - it should contain a clause saying that if there are any restrictions on the deeds not disclosed at the time of sale, you can withdraw from the sale without penalty.

Your solicitor's visit should be accompanied by a government-authorised interpreter, who is there as an impartial third party to make sure you understand the details of the contract and the answers to any questions you might have.
