Has anybody stayed at the Elba Sara after booking with Direct Holidays as we have had to stop at a recently completed hotel due to the Elba Sara being overbooked, in total this affected around 40 people on the day of our arrival and several more families before we returned home.
We were informed by Direct Holidays that this had only flagged up on the system on the day we arrived and there was no way to contact everybody.
What we are trying to find out is if Direct Holidays knew about this before we travelled as conversation within our group of families pointed to Direct Holidays quoting to a member of a family who contacted them on the Friday before we travelled, being told they were not stopping at the Elba Sara but that somebody would call them back to confirm but they never did. When they contacted Direct Holidays on the Monday they were assured they were staying at the Elba Sara but on arrival Wednesday they were in the same hotel as everybody else who travelled with Direct Holidays.
Is it possible to use the Data Protection Act to force the T.O to show us the paperwork relevant to our booking.

Don't know enough about the Act to help you out on that one, but I'm sure Ros will offer you very good advice if you give her a call. All I can do is sympathise as you've now joined the ever-growing list of disgruntled MyTravel customers who have had their holidays 'rearranged' this summer. I find it totally implausible for them not to know your accommodation was overbooked. And I bet it wasn't their fault, eh, nothing to do with their admission of downsizing on the number of holidays on offer this year.
The Data Protection Act is probably not relevant to your situation because it is concerned with protecting your privacy and ensuring that information that any public body or company holds on you is kept confidential. If they hold your personal details or information about you on file they are required to regularly check that they are up to date and accurate and deleted as soon as possible when no longer required but it probably doesn't extend to things like being required to give you details or copies of their records of any commercial transaction which don't contain personal information about you in them. You would need to check whether you have a right to this paperwork under the Freedom of Information Act but I've a feeling that it might only apply to public bodies not companies.
