I can confirm that Trading Standards in York at least are interested, and will prosecute subject to the quality of the evidence, in cases of false or misleading brochure descriptions, dishonest selling, and breaches of the Package Holiday Regulations. So were their colleagues in Warwickshire in respect of a similar case at the same hotel.
I see no reason why they should not prosecute and ask for compensation to be awarded, but in your statement you would have to indicate your financial loss, plus how upset and disappointed you were.
About seven years ago the going rate was £2000 fine + £2000 costs for false brochure description regarding a swimming pool and other hotel facilities which were falsely described in a brochure. The company was fined the same in Warwickshire.
These prosecutions can cost travel companies dear and don't forget they are tried before lay magistrates who like as much as we do, spoilt holidays and to be mislead and ripped off.

Hi are you sure it said at time of booking and not at time of arrival.
Yes - on my confirmation of details supplied by the travel agent it states "Accom: Escape Hotel & Spa Facilities Booked Standard Upgrade to Superior Room - All Inclusive"
Overall I believe there would be enough evidence to convict the travel company of a number of offences!
