I agree with most of the posters regarding personal injury claims. If there was a chance of post traumatic stress emerging then when that happens and not before is the point at which advice should be sought on that particular angle, in my opinion that is.

I too hate the compensation culture that we have. It is absolutely fair enough that if you've suffered an injury, severe stress or mental anguish or loss of earnings due to something which was clearly the fault of another that compensation is only right and just. But I keep seeing all the time people asking what they can 'get back' when they've been inconvenienced or when something is a plain old accident. Okay, I guess any accident you can search around and eventually find someone or some organisation to pin 'blame' on for your claim, but honestly...... we all suffer through heightened insurance costs and ultimately the cost of goods and services will have to rise accordingly.

As for the OP I am not talking about you above, I can fully understand the actions you took at the time and the fear that this shift in the flooring could easily have been an indication of something far more serious about to happen. I think your concerns were somewhat dismissed at the time and you should have had an apology from the hotel manager or at the very least your rep. Common courtesy to check you were all okay if you like.

I think this has gone off topic onto the rights and wrongs of legal action, and I think the vast majority of us agree that it is worrying what happened to the OP and that he was right to move, and the hotel should have dealt with it better.

However, I see no comparisons with ctoau's horrible situation. Surely there is a big difference between something traumatic and something traumatic that might have happened?

Litigious society is already here, and it costs us more through taxes (NHS damages), insurance, and holidays, and the main beneficaries are ambulance chasers. I would never demean a genuine case, or deny the right to seek legal help as a last resort, but this situation is surely not such a case.

As i'm probably the only person on this board that has actually sued, and won for 'Mental Anguish' maybe it's a tad hypocritical, but I do despair sometimes....

Just off topic a bit to the post traumatic stress thing. OK so someone may have suffered post traumatic stress after an incident - for example the motorbike crash. But just one question - how does having a few thousand pounds lobbed at you make the stress go away?

has anyone done anything about having the building checked to make sure it's safe?

Personally I'd love to know how they are going to explain the dip in the flloor to new guests, it will be on a par with Fawlty Towers!

The floor was fixed the next day

It is a reasonably common occurence with tiled floors if there is a slight movement in the building structure or perhaps there was a slight earth tremor

If they relaid the floor the next day it was only a minor problem

As for looking for compo if they were so anxious about the building why did they stay and say they enjoyed the rest of their holiday

If it had been me & I felt the building was unsafe I would have been out of there immediately
