Ok, where do I begin? We decided 2 years ago we wanted to go to Thailand, my husband, myself and our 2 best friends. After looking into everything in great depth we booked with Hayes & Jarvis in June 2007 to go in November 2008. We paid a total of £6388.00. In September 2008 we upgraded our rooms at a further cost of £140 to get a seaview, this was after an indepth conversation with one of their advisors, who even talked me throught the hotel website showing me the rooms that we would get. So, come November 21st we set off, our itinery was 3 nights in Bangkok including some excursions. 1 night Kanchanaburi (bridge over river Kwai - fantastic!! ) 4 nights in Chang Mai including excursions (elephant treking & others), 8 nights in Phuket, all with private transfers. When we were being transfered from Bangkok to airport for Chaing Mai flights we were returned to our hotel, they said that our flight was delayed. We actually found out that the airport had been taken over. We sat in Bangkok for a further 2 nights in our hotel at OUR expense waiting for information about what was happening. No-one told us anything, we kept asking reps Turisima-asia for advise & help, nothing!!! Eventually we asked them to get us out of Bangkok and as we had missed most of our Chaing Mai holiday could we go straight to Phuket. They said we would have to pay £250 each to hire a car to take us there. 13hrs driving. We asked if there was a train, No they said, a bus NO they said, anything any cheaper NO they said. So we had to hire the car. (We found out later we could have travelled by luxury coach for £20 each!!!!) We got to Katathani Resort a day earlier than we should have and had to pay a further £140 each to get a room for the night until our actual stay started. Our room even though we had upgraded did not have a seaview, we looked on to a brick wall. I queried this only to be told the rooms we had booked DID NOT have a seaview. I told them we had paid extra for this, they told us we had to upgrade even further to a junior suite to get a seaview, we were now getting fed up of paying out & I said I would speak to our rep. Which I did, he was neither use nor ornament. He did nothing! I asked again at reception only to be told the rooms had no seaviews. When we finally got home in mid December I wrote to Hayes & Jarvis within 2 weeks sending them all documentation to show extra expenses, proof of all I wrote about, and photos of our 'seaview'. They wrote back to me on Jan 7th saying they would reply to us withn 28 days. 53 days later, and after many many phone calls from me in which they told me everytime everything was sorted and I would have a letter withing a day or so, they wrote and gave us £941.00 back a total of £235.25 each to re-emburse us for the whole of the Chaing Mai part of the holiday, flights, hotel accommodation, private transfers, excursions, and flights to Phuket - doesn't add up to me, but still. Next stage I rang the person who was dealing with my complaint and told her I was totally dissatified with this and wanted the seaview monies back also something for compensation. She told me I had to put it all in writing AGAIN!!! So I sat down and did it all again. I got a letter telling me they would deal with my request with 28 days! 32 days later I get a letter telling me that although they understand my upset they cannot help any further. But as a GESTURE OF GOODWILL!! they sent ME a credit note - remember there are 4 of us, 2 couples on this holiday that paid for the upgrade. But they send ME a credit note. Also I told them in no uncertain I would never book with them again so they Know that that this of no use to me...............................
Can any one advise, I want to know where/what to do next, at the least I believe we deserve or upgrade back - but I also feel we should have been given something as compensation for a terrible holiday. Things were far worse than I have written but its a very long story and this is the best condensed version I can give you. I feel we have been treat appaulingly,

Re: The Seaview Rooms, if you paid for Seaview Rooms that what you should get. I'm a bit confused though, having seen the Kata Thani, all rooms had (good?) seaviews? The were just incorporating the Kata Bhuri, a cheaper hotel behind it (which if I remember rightly, didn't have any seaviews as the Kata Thani was in the way?). Either way something is up. Did your confirmations say 'Seaview' Rooms on? If so, you deserve some kind of recompense.
Re: the other issues to do with the take over of the airport.
There was very little that I could see that H&J could do. Events were moving so fast, information was coming through inaccurately, and no-one knew how long the protests would last. It makes sense that you couldn't get up to Chiang Mai.
It also makes complete sense that you couldn't get to Phuket without chartering a car and paying £250.
There are no trains to Phuket, but all the trains South (including ones that go closest to Phuket ), and all the luxury coaches that do go were completely full during this time. There was no chance of you securing a seat unless you went down to the bus terminals and stood around for hours fighting with the queue's and the masses trying to get out (which is what people were doing - there were a lot of desperate people trying to get out of Bangkok, and a lot of tourists desperate to make it to Kuala Lumpur, Phuket, and Singapore where they could get flights from). I know this as I knew people trying to get out on these dates (and ended up chartering mini-buses as they couldn't get luxury coaches).
And it was completely force majeure, so H&J couldn't have been expected to pay for the private hire car as they would have had thousands of people in Thailand at the time. As long as their agents in Bangkok (Turisma-Asia) ensured you were safe in Bangkok, and kept you informed where possible, it sounds like they executed their responsibilities. A lot of tourists were inconvenienced far worse than yourselves, but at least you did the practical thing and got down to Phuket asap to restart your holiday.
A lot of your problems stemmed from something they had little control over, and it sounds like your timing co-incided with the worst possible dates. But I would be interested to see where this goes.

TOs have a duty of care and returning you to your hotel is the only thing they could do. Probably the safest place to be when such incidents occur.
I do not know who should pay in such circumstances - The TO or you, hopefully claiming back from your insurers, providing such incidents are not excluded. No doubt one of our members may be able to throw light on the legal position. The hotel quite correctly does require someone to pay.
As I understand your posting you have now recovered these costs. Your decision to make your own way to Chaing Mai is exactly that. Your decision. Your choice.
The TO would move you as soon as was practical, but they are dealing with more than just your party so it is not quite as simple.
The additional nights cost when you arrived early is, in my opinion, your responsibility.
As you had paid for upgrading then those costs should be repaid.
How much was the credit note for? You do not say. The general advice given here on HT is to politely refuse vouchers and credit notes and ask for a cheque.
You say you feel you should be given compensation - My question is why?
The events which took place were outside the control of the TO. It may have caused you distress but it also did the same for thousands more. Having been in a country following a revolution and the obvious unrest I can sympathise but unfortunately this does happen. I note only today that the Foreign & commonwealth Office have now revised their advice re travel to that part of the world following the events of last week.
I have no doubt the reason for the delay in getting a reply was due to them awaiting the information from their people who were there - not always as speedy as is should be at times.
Did you complete a formal complaint form with the rep whilst you were there?

Maz, as far as your credit note goes, if both parties were on the one booking, the tour op will send everything out to the lead name. Any credits, cheques etc. will only be made payable to that person.
If this is the case, were you moved to the 'seaview' room that you had booked through H&J after that 1st night for the remaining 8 nights in Phuket?
