I would have thought some 'small-print' has been missed somewhere. What is the point of a pool if you cant use it at prime-time?

Sounds like someone may have been given a fee by the nusrsery for the use of the pool, I can't see why they would give up 2 months of the use of their pool for nothing.
you need to have a meeting with the other owners and you should ask the nursery for a copy of the agreement.

Similar thing happened to us, we stayed in a Complex of 5 Villas in Dalyan with a Shared Pool. One of the Villas was occupied by a Turkish Guy who built the Complex. We weren't banned from using the Pool, however he had invited all the kids in the Neighbourhood to use it so it was often too rowdy for our 4 Year Old to go in.

Other than that the Hol was great

gogs I very much doubt that there is any legal standing in this one and would suggest the locals cannot stop your guest from using the pool after all who is paying for the maintenance of it??

Hi Gogs,
if it's not written down then it ain't legal. Did your estate agent or solicitor let you know about the resident committee.
The pool is rented by Pynokyo school from 15th july to 31 aug from 09.00 to 16.30.This is from monday to friday.other times it can be used by the guests.Did your agent tell you about this. If not I would try to find the relevant paperwork from the sale and see if there has been a breach of contract.

thanks everyone for your help chelsea boy could you tell me exactly what paper work i am looking for all we have is a tapu no one told us about the commitee but when we bought the house it was an empty shell
we dont know if there is any agreement in writing do you
if anyone can please give us any more advice it would be appreciated

when a new block/complex is built in Turkey they have to set up a commitee and appoint a director to collect the services charges and administer things like garden and general maintenance and pay comunial electric charges etc. to hold the meetings and make decisions they have to have a quarum there propably 60% of the owners who set up the rules for the complex. If they had these meetings woth out you being notified and without the required number of people there then no decisions they made can be enforced.. You need to go back to your agents who by the way should of explained some of this to you, and find out what has been happening in your absence, and if this was decided without your consent then demand to see the contract with the nursery school, make sure the finacial people (Maliye) know about it and generally make a fuss, that way you will get some action. Int he meantime tell your guest to use the pool as they wish as you have not been notified and therefore any agreements made without your knowledge will have no or little legal standing.

Gogs Further are you in contact with the other Brit owners and were they informed of any meetings etc and how many Brit owners out of the eight of you are there??

hi bryn we appreciate all your advice this sounds brlliant
we think there is 4 or 5 brits out of the nine
we have been in constant contact with the agents and all we are getting is the run around they are not helping us at all
we have never been informed of any meetings but we are being charged comunal the first 2months 70ytl all other months are 50ytl do you reckon this is alright
the builder of the complex owns the nursey and the caretaker of the nursey is the caretaker of the appartments and he is the one who collects the money
we are trying to find out who the rest of the other brits are but we are in contact with one and he has never been informed of any this the first he new was when he arrived on hols and got told to get out pool he deals with the same agent and is getting run around aswell
we have been asking for a copy of the contract from him but he keeps telling the man who is renting out our appartment for us that he has no say

gog just found out that a complex in Lara tried renting out their tennis courts to a company here in Antalya and the local Belidiye put an immediate stop to it as it is illegal for this type of contract. Get hold of the Belidiye in Marmaris and let them know what is going on.

Gogs by the way the comunal charge is probably about right as those pools arent cheap to run.

Gogs not sure of the Belidiye (town council) address and tel numbers in Marmaris, nor the "kaymakan" (who would be useful in this and you should copy everthing to him as well) but hopefully one of the Marmaris guys may be able to supply that info for you, try chelsea boy or JT. My brother in law advises that you write a letter of complaint and explain the circumstances and get all five Brits to put their names on it and sign it. dont forget all the details about the complex address and nursery school address etc.

Sounds like a load of old fudge, someone is pulling a fast one, nothing in writing not legal. Have you been in touch with the other residents..?

hi copy everything to who and just to let you know we have got appointment to see our lawyer when we go over on the 12th september another great holiday this will be we will take your advice though and get the other brits to sign
hi mork only in touch with one of the other residents at moment cant seem to get information of the other residents names but will try when we are back over

Gogs should have said the Kaymakam is a local official a bit like a town councillor, the system is a bit different in Turkey. Dont forget that if you go to a lawyer to tell him to make sure the other side end up with your cost.

just been told by one of the british owners the one that we are in contact with that he has just been told that the lawyer we were told done our paper work was on holiday and he never done our paper work and if we want him to do letters or find paper work it will cost us £500 each for this now we don't even know who done our buying and legal things this just seems to get worse is there any more advice you can give us on this I also went to see a turkish friend that I know here to get him to translate the tapu and he said there is no mention of the pool on it but that it should really be on a seperste piece of paper butwe dont have this but he says with the measurement that this includes the land were the pool is built

Gogs this does seem to be getting worse, dont pay a solicitor 500 each for letters this is ridiculus. try and get hold of the other Brit owners and get all the facts together. I will PM you.
