still no further forward apart from they now say that they have found and spoke to the lawyer and he says we are part owners of pool
but we were wondering if we could have document proof of this do you think this is possible
the builder has stopped speaking and wont give us the supposed agreement
the owner of the estate agents is still trying to find out who all the owners are and is going to give them our number or email to get in touch
he wants us all to get together and approach the nursery but this is impossible he says we wont get any where with just one of us going over have you any other suggestions and have you any idea when chelsea boy is back as he seems to no all and we were wondring if he has actually seen this agreement

ps will keep you up to date if we ever get this sorted we arrive over the 12th september so hope we can get something sorted as we would like to have a bit of a holiday

Gogs have a look at your Tapu and on it it should say something like 'arsa 1/9 payla' which means you own one ninth of the complex land and hence one ninth of the pool. which is then all the documented proof you need(if you arent sure fax your Tapu and we will look at it here and let you know). Get all your contacts for the Brit owners and get a letter together and all sign it, this will then be accepted by the Belidiye you will need to attach copies of your passports and tapus with this.

İ dont know where Chelsea boy is at the moment, and most of my contacts in Marmaris dont speak much english, but some of them are quite high up in the local Govt there. Dont worry too much as this will get sorted and it wont spoil your holiday.

Gogs if it was 9 equal shares it would be 7/63 İf my maths is correct but it could well be that one or more of the apartments is bigger so they get a slightly bigger share of the plot. Which in your case sounds like you have bought a bigger one as you are getting that much bigger share. This would be normal.

gogs On the face of it it looks correct as if you have the biggest apartment then you have the biggest share in the land plot and it does include the pool and everything on the plot. wether you will have a bigger say in the owners association depends on how it is set up and it sounds to me like it hasnt benn properly set up yet as you werent informed of any meeting etc refer back to beginning of thread. But its most common for one owner one vote in these things.

As the country is more than a little corrupt, it could be that one of the Turks has taken a bribe (known locally as an 'acceleration') to allow the nursery use of the pool when they had no right to.

I would simply use the pool and let them prosecute you for using part of your own property!

I find this absolutely appalling that you cant use your own pool facilites, and feel really sorry for you folks involved in this situation. I own in Portugal and am just glad I have my own pool and am not attached to any condominium. Fight your fight friends and stick together, I hope it all turns out ok in the end. Regards Jayjan

soory i've been out of action for a while. Now I have a new job and new laptop so can keep in touch a bit better. who is the solicitor and who are the agents.You should be able to find out other residents names and start making enquiries.perhaps when you are over next time we can meet and sort this out. It does sound dodgy with the builder owning pinokyo. if you need anything done on the ground here in marmaris I will try to help.

Gogs what Chelsea boy means is hes finished fiddling with his goats and has more time now But seriously if you have Chelsea boy on the case I am sure he will get things resolved as he is more local than me. As I have said variously you have no probs with your Tapu and its only one of the Turkish owners pushing his luck who will soon back down when he knows hes not going to get away with liberties. Enjoy your holiday and dont let this stress you out.

Have only just been catching up with all the posts, and came across this one.

Gogs will now be in Marmaris, I just wondered if this is one that could or should be taken to the Jandarma? It seems everyone I know, when they have a problem they go to the Jandarma, to sort things out.

Hi. I am the other Brit. owner involved in this debacle. I will be in Marmaris from 3 to 17 October and I wonder if Bryn or Chelsea Boy could get in touch with me. We certainly need some help as we appear to be going around in circles.

Bryn here I spoke to Gogs down there last week and we have asked him to get a letter together from as many of you as they can all signed and accompanied with Tapu and passport photocopies and we will try to get things translated and passed to the right people for you. In the mean time we are trying to get someone in the Belediye on your side as well. Dont sweat it too much though it shouldnt be a big thing to resolve.

I have got a contact in the Marmaris Belediye he is the press officer for the mayor, dont know if that would be of any help.

sorry for not posting any updates earlier my next door neighbour has justed returned with surprise surprise no further forward our so called estate agents has got letters from the both of us and now supposedlly going to give to there legal team i personally dont hold out much hope with them iwill give it another couple of weeks to see if i hear if not plan b looks best way forward so bryn looks like i will need your help
