I am disabled with a mental health issue.
And while on holiday with Thomson in spain I made a complaint about our room and we had to pay £96 pounds to upgrade.
I found the rep not very good and after telling her about my illness she became dismisive.
it got to a stage were I started to record the convirsation. there is a part where she refers to my face scars as been minor and she has seen worst in more detail
This was said in front of other people and that was the end of my holiday as i felt so bad
thomson want the recording of the rep and also the photos of the room, not sure what to do hope you can help

A few questions so we can help as there appears to be two different issues firstly the room, which hotel? and what was your reason for your complaint?
The second issue appears to be that the rep appears to have treat you differently simply because you're disabled and this has of course upset you greatly. The second issue would be very difficult for me personally to advise you on as it appears to be a case of proving discrimination and I would suggest you contact Simpson Miller solicitors(contact details on this forum) to talk over that issue with them.
It's no wonder that Thomson would like a copy of the recording - this is a potentially much more serious and damaging case for them that could cost them a lot more than just the average holiday compensation claim. You potentially have a case not just against the rep as an individual but also against Thomson as her employer. Under UK law they are supposed to not only provide staff training for their staff to ensure that the law is complied with but are also supposed to ensure that it is complied with and from the sound of it they are doing neither. Depending on the nature of your disability and/or your mental health condition I would suggest that you consult the appropriate campaigning or support charity - they will have a much better idea about whether you have a case that is worth taking to law and will also be in a better position to refer you to a lawyer with the appropriate experience. They might even be prepared to help you directly take the case to court via their own in-house lawyers if they think that this is an area where there is a need to establish case law re a TOs responsibilities with regard to their employees behaviour in resort and which court's jurisdiction applies.
I realise that you might not want to discuss the details of your situation on an open forum like this, so I will send you a pm which you can then reply to if you would like more information on which charity or support group to take this up with because as 'newbie' you won't be able to pm me first until you reach the threshold number of posts to the HT forums.
