Now that Inghams have got their electricity back on I've found the text about the Lion on their site so they may be behind the mistake and the various agents have just walked into it without realising.

Still haven't found the official sites for either hotel but have found a few interesting details. I'm glad you're going to try to be positive, this may actually come good for you. The Bansko seems to have only about a quarter the number of rooms as the Lion but similar facilities and a bigger pool - so more to go round for everyone! One review mentions it's early on the drop off list for the airport coaches. Since the Lion is close to the slopes it means it's further from the centre at night! 600m from the lifts might not sound far but when you've walked it in ski boots carrying skis I think just 900m more in a bus might not sound so bad! Despite being the same rating as the Bansko, and closer to the lifts, the Lion is cheaper at Inghams - there's got to be a reason for that!!

Your holiday was not as you expected
Your holiday may not be as you expected because of:-

"¢poor accommodation
"¢the facilities at the accommodation or resort were not what you were led to expect
"¢the hotel was incomplete
"¢the resort was not as expected
"¢the surroundings were noisy or dirty, for example, the hotel backed on to an airport or building site
"¢the holiday was not as described in the brochure.
If the holiday is not as you were led to believe, you will be able to claim compensation.

***However, If the holiday was not as you expected because it was different to publicity material you have seen or to an advertisement, you may be unable to claim compensation. This is because publicity material and advertisements do not form part of the contract you made with the holiday company when you booked your holiday.****

Descriptions of holidays must be full and accurate. If the description of your holiday was not an accurate one, an offence may have been committed under the Trade Descriptions Act and you should complain to Consumer Direct on 08454 04 05 06.

**** as said above, its the pictures that usually draw you in first :que so really its unfair they can get away with that side of things but once it hits the 1st march 2011 the ASA will have more clout when the new rules come in.

There is a kind of disclaimer at the bottom of their web page, to say that they take no part in the advertisement/pictures as that is done by a 3rd party, so basically I don't have a chance of compensation.

But if your local garage put a Ferrari in the window and said why not buy a car like this for £1,000 and fobbed you off with a Lada it would be OK. I think not. If you are advertising a holiday and use a picture as part of the ad then you do have a duty of care to ensure that the ad does not mislead.

duty of care is a good phrase here given that a picture of Valetta Harbour slipped in as a representation of a Bulgarian ski resort! In this case the company did offer a full refund when the mistake was pointed out and seemed to have dropped that holiday but others were still offering it with the mistake.
