I contacted the Air Transport Users Council and they said the company could use that as a get out clause as it was something unforeseen and outwith their control.
In my personal opinon the new regulations are a waste of time.

If everyone was to complain to the same Dep/Org.
there might be a chance the Law might be changed for the benefit of the passenger.
Now as an individual the travel companies pick us off one by one
we are treated as a joke .Why should we be treated as the poor
relation of the consumer laws , millions fly every year

Including all the get out clauses they are allowed to use technical problems etc.
