I am interested in what you have to say but I would have asked the Agent to change the flights. I would have stood over him until he did so. I would have printed out the details from the Thomas Cook web site with the availibility.
I once had a problem with an accident on holiday. I felt unable to sit in a tight seating from Miami to London. I had told the Cruise Company that I wanted them to upgrade my flight home. They then lost my baggage as it did not come off the ship.
The tickets I had were not upgradable and I rather foolishly bought new Premium Economy which gave me much more leg room. This single flight ticket cost £925. I made a complaint and sent my ticket to the cruise company. At first they refused to help me or to acknowledge that I had a problem. After a couple of letters and I had also taken a taxi to the hotel they gave me either £800 in future cruise or £750 in cash. I choose to take the cash as I could then go where and when I wanted without restrictions.
I was fortunate and like you if I didn't get the money it would not have broken the bank but I was hasty in making the decision to just do it and sort it out from this end.
Don't really know what advice to give you but as the others are saying it is not difficult to go to the small claims court and it will cost them more to be represented so they might settle out of court to save them the cost.

with hindsight we may all do things a little different.i could have booked direct and have done in the past with no problem.when i first phoned i had no information about flights because i was finding out dates for the availability of the apartments(he is the agent for them in england)as there is only one 4 bed out of 20 apts i knew i might be tied to dates which i was.whilst sorting the apartment i made enquiries about flights and the flights offered (the thomas cook one)were reasonable,but more important fitted in perfect with time ,date,accomodation and gulet,so i accepted them.i had no reason to think that there would be any problem.i could of declined the thomas cook flights but would have then had to hunt for some flights myself.i think maybe after taking my booking someone in the office has found some cheaper flights (the fly jet ones,same days,close times)and booked them instead ,unaware of my previous conversation about flyjet.if this was the case i am sure we could have resolved the situation the next day if i had spoken to a reasonable person thanks john
