Me and my partner have just got back a week early from Cyprus because we did not enjoy our holiday.
Having never used a travel agent before and always booked online ourselves so we decided to try it! What a mistake that was. We went to First Choice and told the lady what we did and didn't want from our holiday, we had no specific budget in mind- pretty much anything up to £1000 each would be fine, no preference to what country we want to go to as long as it has the things we wanted. To make it easier for you to read I have put them in bullet points;
What we specifically requested from the travel advisor:
*A very hot climate- we are both mediteranean so love the heat, we are used to over 40degree heat in the summer.
*Nice sandy beaches.
*No need to hire transport while we are there, we would like to have everything within a reasonable walking distance or reachable by bicycle.
*No children at our accomodation- we dont have kids ourselves!
*We have always stayed in 4* hotels or above.
*We would like to stay in a hotel and not a resort, somewhere where it is not too built-up and has lots of local shops/cuisine.
*We are not big drinkers so would not like to be surrounded by pubs/bars/clubs etc. and great big high-rise hotels
*We would like to go somewhere unspoilt and not too English! Somewhere with history and culture, not sports bars and English Cafe's!
* Our recent favorite destinations include; Dubai (Hyatt Regency Hotel 5*), Taormina Sicily (Baia Toarmina Hotel 4*) etc.
And this is what we got;
*Latchi in Cyprus
*In the middle of nowhere with nothing to do
*Had to hire transport to get around- an extra 200 euros a week
*Nothing but English bars, pubs and restaurants (you could even have a roast dinner on the beach on a sunday!)
*2 star hotel!
*children in the hotel!
*Pebbled and littered beaches
*Average temp 30degrees C
*Very little historical sites/places to visit (managed to cram all there was to see in one day!)
This was pretty much the opposite of everything I had asked for! Not only did we put up with the above, I found Cyprus generally as a whole had a very bad atmosphere and completely lacked charm. I feel as though we had been completely mislead by the agent and mis-sold our holiday. She assured me and my partner that where we would be going would have everything we had asked for!
When we complained to our rep out there, it was a minimum of 600 Euros to change to another hotel so I asked if we could come back early. We originally flew from Bristol but had to settle on flying back to Gatwick for 400 Euros and then to sort out transfers to Paphos airport and then getting home to Bath from Gatwick! (2.5 hours away!)
Now we obviously want to be comped for this as it has turned out to be a nightmare and we are seriously out of pocket- I managed to get back to work the day after, however, my partner is self employed and cancelled 2 weeks worth of clients to go on this holiday so he is even more out of pocket than I am! I understand that It is my word against the Agents' word, we havnt managed to speak with her yet as she has been away and we dont want to deal with anyone else at the travel agents because they wern't involved in the conversation.
We were not given a holiday brochure to take away with us and didnt feel the need to research it further as we were fully assured this holiday would meet our every need and I thought that was whole point in putting your trust (and money!) in a travel agent!
Please let me know your thoughts on my situation, I am feeling really taken advantage of by First Choice and dont think I will ever use a Travel Agent again!

Whilst you did ask for so many things I think achieving all of them would be impossible. I think you will have a difficult time achieving compensation on the grounds that you were missold a holiday. The TA will give you the information but it is your responsibility in accepting the holiday offered or rejecting. I take it that this was not a holiday with accommodation on arrival.

I would think it would be almost impossible to give you everything you wanted. Did you give Dubai as an example of what you liked as that would have confused issues.
Your main case would be the fact that you specified(?) 4 star and got 2 star.
I'm sorry you had a dreadful holiday. Leisure time is precious to us and holidays are not cheap nowadays. I hope you will make full use of HT before you book your next holiday and research the destinations, resorts and ask loads of questions.
You have a very long list of things you require. I doubt they could all be attained for your budget. As others have said you should do some research for yourself, then your TA could refine it for you and advise you. At then end of the day it is your choice, you can walk away before you book. I think your expectations were unrealistic. As for the weather? You need to be closure to the equator for those types of 40o temperatures. Even then, you might have rain, unless you are in the desert of course.
If I was told certain things would not be met whilst I was sat infront of the Travel Agent then fine- there are certain things I could've prepared myself for but she didnt! I gave her a massive scope in terms of countries to go to- why did we get sent somewhere that is pretty much England with the sun!?!
I felt no need to research the holiday- yes, perhaps very naive of me but we went in, sat there and booked it there and then as she seemed to be confident in what she was doing.
Why were we assured it was a 4* and an adults-only hotel? Why were we told there are lots to do around where we were staying? I can assure you that there wasnt much to do- I dont know how far you expect the two of us to travel on a moped to get to the sights? But I draw the line at over an hour- I get neck strain if Im sat on the back any longer
I dont think I asked for too much; somewhere not in the middle of nowhere, somewhere that doesn't only serve English food everywhere you go, a four star hotel with no children and a place that is not full of chavs who drink into oblivion and watch sport all day! This seems to me to be pretty much all Cyprus had to offer! Well the West coast did anyway- but I can imagine the East (Ayia Napa side) does too!
In response to the budget- we didnt request to go away for two weeks, the travel agent recommended it! I was happy with a budget of £2000 for 2 people for a week.

That pretty much sums up Cyprus and I would have thought that this was quite widely known so I am surprised that her suggestion didn't ring alarm bells with you. Either way, I think it's going to be difficult to prove that you were mis-sold this holiday - it's going to be her word against yours. In the end, the staff in the big TO linked shops are there to sell you a package, preferably one provided by the parent company. I think it's unrealistic to ever expect truly independent and personally tailored recommendations from a shop like First Choice. There are people who can do the job you asked of her but they tend to be found mainly in the independent sector and might well charge you commission for the sort of detailed job you wanted her to do on your behalf. I know that you probably don't want to hear this, but going into a large high street travel shop with such a specific list of wants but little direction on 'wheres' was asking for problems.
In the end there really is no alternative to doing thorough research yourself - I think that you might have to just put this down to experience and go back to what you did before. I haven't been on a mass market package for over 5 years now because, like you, I have particular likes and dislikes - I'm getting fussier the older I get and frankly can find little that attracts me in most of the offerings of the big mass market TOs. Even when I did use them, I did my own research beforehand and went to a small independent TA with a list of potential locations and hotels and got them to come up with the best deal available - I also made sure that I took away a copy of the brochure and checked it out before I made the booking.

There are some very nice beaches in Cyprus - just a matter of where you are staying - It is not a south sea island surrounded by them.
Quite possible that the UK based TO lists a hotel as no kids. Hotels are by their nature international and there is no guarantee that a continental based TO operates the same way.
Star ratings are something often questioned. Stars are not a real guide. I have stayed in them all at various times and it is not often I have agreed with them.
You specified not in a resort - I assume you mean not in a main residential/commercial area. If that is so then you have difficulties in providing exactly all you want.
Not too English? Well as Cyprus was a British Colony until 1960 and is a major British military centre, is a developed country and a member of the EEC and a major tourist destination what did you expect?
Little in the way of history - You really are joking.
Getting around - well you are visiting a country and whilst small compared to most only the most dedicated cyclist would achieve much. You do need to travel "the country" to appreciate all it has to offer.

Your choice to come back early.
You say you have always done DIY - then you are at fault - all those I know who go DIY have done some research beforehand.
You gave the agent a budget and they provided what you asked for.
If you want better then you really have to visit a specialist and give them a detailed description of what you want.
Found Cyprus generally as a whole had a very bad atmosphere and completely lacked charm.
We are booked to go for the fifth time in October. We shall hire a car and explore the island finding things ancient and modern and enjoying them. We rarely visit anything twice and doubt we shall ever discover it all.
The people - well all those we have met - have been polite, helpful and welcoming.
Finally they did not give you a brochure - Oh dear - but did you ask for one?

Maybe I will just have to put it down to experience, I had no idea that these travel agents always usually recommend places like this- I suppose they cater for the sort of people who enjoy the sorts of holiday that I cant bear!
I have definately learned my lesson the hard way, I know never to go to a Travel Agent again- hopefully I will never have to experience that sort of holiday EVER again either. At least I know where to go if I ever breed loads of children and turn into an alcoholic that likes to watch sport all day long whilst eating my roast dinner on the beach! First Choice package to Cyprus. My goodness, I thought the ITV series Benidorm was a fictional programme- I didnt know people/places like that actually existed! Until last week that is! lol.
A bit off topic but at the budget you were willing to pay, I would look a bit further away - look at Thailand( but choose your destination carefully, or somewhere like Bali( where I'm off to soon )

As I say I'm sure there are excellent travel agents out there who are worth their weight in gold, but unless one is recommended to you, I think as you now know to your cost, you have to double check what you are being given. Unfortunately unlike telephone booking a shop will have no record of the conversation, so proving your case could be difficult, but it will hopefully make you feel better to complain directly to the person involved.

Cyprus is full of history but you do have to search for some of the sites. It is also very beautiful if you head up into the mountains.
A silly decision to return home early - it would not have cost you much more to have booked yourselves into another hotel and got the flight you originally booked home. As you are used to doing diy that should have been a doddle for you. Paphos has some very high quality hotels.
As for the temperature then Cyprus can get very, very hot in the summer but with the weather the way it is at the moment there is no guarantee of anything.
I don't thinks you stand a chance of compensation - no travel agent could have given you everything you required - a degree of flexibility is needed.

The TO is, on this occasion, blameless (not often we say that).
The complaint is with regard to the agent.
Now we see plenty of complaints here on HT regarding TOs and the holidays they sell, failing to meet standards, in this case the poster is not complaining of that.
Their dissatisfaction is with the agent, or their representative, booking them onto a holiday that failed to match the specification supplied by them.
Any claim for compensation could only be made against the agent.
Unless a written specification for the holiday was provided by the person booking, then it will be difficult to prove the agent was wrong in booking them onto the holiday they undertook.
There is also the issue of the brochure. Even if the agent did not have one in stock it should have been possible to obtain one.
The poster claims to normally book DIY. A court would ask why they had not taken positive steps to research the destination and simply relied on the word of the agent.
Personally I see no chance of any success in recovering damages.

We don't know all the facts.
However please let me make a bold assumption that the booking could have been made as follows: OP's walk in to TA off high street after seeing some great window offers.
"Hi, we want a last minute deal - don't care where, has to be hot, budget is this £x we can go only on these dates, doesn't matter how long for (we like culture, no kids around etc)" as long as we are back by this date.
I expect at first the TA, would have looked at destinations based travel dates, flight availability, and how flexible the passengers were and the departure airport etc. They have to work with something after all.
Is my guessing way out of line or is this slightly close to what happened? OP said they booked it there and then. Sounds to me like it was a case of 'what late deals do you have?'
I resent being tarred with the brush that the OP is calling all tourist to Cyprus. Lager lout swarms of children (Nothing wrong with children) Incidentally I am now a Grandmother with grown up children.
I have taken 4 holidays in Cyprus in the winter and enjoyed it very much stayed at the Paphos Amathus Hotel.
I can't believe that someone would just walk into a TA and book a holiday without finding out a bit about the Island or the resorts etc. A lot of young girls work in TA paid a low wage and how can they be expected to know everything about every resort in every country in the world a BIG ASK.
As someone said eg Travel Counsellors are home agents who are paid commission and who are very experienced with a lot of knowledge and they have and will take the time to marry up requests as best you can. £2000 is not a lot of money to spend when you want an upmarket holiday and to get flights and 4-5* hotel in some exotic part of the world. I think in this case there is no one to blame here but themselves. They could have moved hotel or resort and paid for another hotel Cyprus is not a cheap island and most hotels are on a B&B basis.
Hopefully a lesson learned here and we each have a responsibility to check and make sure that what we are buying is what we need and want.
