Notification:
I here send you this letter to inform you about fiscal representation
in Portugal for NON-RESIDENT and to ask you to change your situation
in the Tax department. You must go with a fiscal representative to the
tax department and change this situation there.
The Portuguese Government has enacted a law regarding tax evasion and
Money laundering. As a consequence the tax departments are also
tightening up their systems to ensure compliance with the law witch
decrees that all non-resident individuals who own property in Portugal
must have a fiscal representative resident in Portugal.
For any transaction involving a property, the tax department is
requesting details of the fiscal representative.
A practical consequence of this legislation is that the tax
authorities will only correspond with the fiscal representative of the
individual regarding council tax bill (rates/property tax), valuations
on the property, retal income declarations, etc. If you do not have a
representative you will not be made aware of taxes due and your
property could be at risk.
I can not be your fiscal representative, because I do not do this kind
of work. But there are accountants and companies with this speciality.
I will advise/give you 30 (thirty) days to change to someone resident
in Portugal the fiscal representation.
If this is not done, you will incurs in sanction imposed in the fiscal
law, beyond stayed rendered useless of intervene in the your fiscal
rights, namely, the claim, appeal, oppose judicially and intervene all
the same in trial of fiscal execution of being aim or reach you.
If you are a non-resident in Portugal, I can advise someone to provide
you with fiscal representation, whereby any correspondence from the
tax department can be received and dealt with.
Please ensure that you send us a copy of your passports, witch must be
authenticated by a lawyer/accountant if they are non European Union
Passports, as well as proof of residence in your home country eg a
copy of a utility bill.
Is this indeed a new law or another money making scheme for the Fiscal Reps, does any body know?
The EU had declared this illegal in Portugal but presumably the Portuguese have ignored the EU.
