I am new to HT's and never use forums but I am so incensed by our current situation that I feel I need as much support with this as possible
We booked a holiday for October half term to Turkey, for one week,it was booked through loveholidays.com and I now believe our contract is with Thomas Cook.
Earlier this week I received an email forwarded from loveholidays, from Thomas Cook, informing us of a flight change.
This flight change is less than 12 hours but the flight now departs on a different day and means us flying through the night and landing at 5:30 in the morning on what is a school day for our daughter and a working day for myself and partner.
I have found it increasingly hard to speak to anyone from Thomas Cook regarding this, the people I have spoken to are unable to do anything as we booked with Love.com and they cant access our details.
Love.com are saying they cant help because our contract is with Thomas cook.
I have also contacted abta who say that it is not a significant change!
I am flabergasted that this is not considered a significant change when we will be forced to keep our daughter away from school and my partner and myself will be unable to work, therefore imposing a significant loss of earning for myself and partner.
My daughters school have categorically stated that they will not authorise any absence for family holidays in year 9 & 10, therefore we will be breaking the law as it will be considered an unauthorised absence if we go!
Any help or advice you could offer me would be greatly appreciated.

Sorry to hear of your problems. As you booked your holiday with Loveholidays.com, your contract is with them and not Thomas Cook. Your contract is always with the agent you purchased your goods / holidays with. I know flight changes are a pain and I sypmpathise, we've all been there, but flight changes up to 12 hours are covered under Thomas Cooks term and conditions so there's little you can do really. Flight changes are sometimes needed and are inconvenient, but they happen I'm afraid. Given changes of up to 12 hours are catagorised as minor and are covered under terms and conditions, there's not a lot you can do really. If you cancel, you'd lose your deposit or even the full amount subject to when you're travelling.

As loveholidays are acting as agents, your contract is with Thomas Cook, but loveholidays should be trying to help you, not just passing the buck! They should be contacting Thomas Cook to see if there is another flight that is more suitable. As it isn't a significant change you would have to pay to amend the booking IF there was another option, but that might be preferable from your point of view?
