I'm after some advice with regards to Thomas Cook. A whole host of things went wrong, prior to & during the holiday. They agreed to pay me £900 in compensation from a Holiday that cost in excess of £2,500 (I have this in writing), I agreed this even though I was still dissatisfied.
This was prior to Christmas and the e-mail stated 10 working days, not including Bank Holidays or Christmas Eve the 10th working day is today and nothing has appeared in my account.
I have since twice e-mailed them only getting the stock "We've received your e-mail and we may take up to 28 days", my reason for not phoning is that I would probably lose my temper as I have spent in excess of 5 hrs on the phone to them, along with hours of typing e-mails. The stress it has caused me is something I never thought possible when planning to go on holiday.
By not paying this they have effectively reneged on this agreement and I'd like to know where I stand from a legal viewpoint. I have all the e-mail trails plus they record their calls so everything I've said would be corroborate.
Would I benefit from speaking with a solicitor with regards to this? Many thanks in advance! Dan
I would assume an adult could make a phone call without losing their temper, no matter how strongly they feel. It certainly wouldn't aid anyones refund if they did. The art is to make them want to help you. Talking about legal viewpoint and solicitors at this stage seems rather OTT.
