can anyone help ,a bit specialised i know but here goes.
we bought our apartment last May and delighted we are too, as most people do ,we took out buildings and contents insurance at a cost of around £100 for the cover we required ,quite reasonable really.
over the close season we have formed our own management committee for the complex of 17 apartments.
As a member of the committee i am researching whether we could cover all properties under a 'block policy' at a much more cost effective way of insuring instead of us all having individual policies.
would anyone have experience of this and any advice?
part 2 to my query is that i am also concerned what would happen if a guest of one of the apartments or for that matter one of my own guests were to have an accident on the complex, say slipping around the pool or something.
i would imagine they could sue the 'complex' for damages?.
can we cover ourselves with 3rd party liability insurance on a 'block' basis as well?
Hope someone can help as it is something that could affect a lot of apartment complex's and would be a good question to ask the agent before leaving yourself open for an accident claim by the first guest who uses your complex !

The insuramce can be got from most banks and insurance agents in turkey.
Sorry i forgot but it is a good idea to have it then if someone does have an accident that you are liable for then the claim can go though the insurance which if a high level claim can be anything from a couple of hundred to thousands. The claim has to be first decided for liability in a claims court.
Do you supply booking terms and conditions to your 'Guests'? Would suggest you have a clause in confirming you no have liability in case of any accident on or around your property?

Although only family and friends will be using the apartment , you never know and even if money does not change hands ,it will make little difference should an accident occur.

Think (but not 100%sure on this one) also under European consumer law.
I have handled many legal enqiuires when i worked for a uk tour op in turkey and they all have these claues but are not actually worth the paper they are written on legally.

It does not matter where the property is, if the contract is made in the UK/Europe then an action can be taken against you here.
i have handled legal cases of this nature reguarly, investigating them etc it even states this now in moxt tour operators contracts with the foreign property so the lack of undertsanding can not be used as an excuse when an accident happens.
Not sure about Turkey but in this country you can take out block insurance, although as you say its specialised. Lloyds definatley offer block cover and some more specialised insurance companies may well do. You can put as many signs as you like up, but negligence is negligence as for as the law is concerned. Of course liablity has to be proven in order to win a case, and this can be very difficult, costly and time consuming. Most buildings insurance offer Public Liability cover as standard. Many also include Employers laibility as well. For instance you may pay someone to tidy up the garden, technically they are employees and could sue you. In UK EL cover MUST be for £10 million. PL cover is usaully around 2 million. Thought I'd give you some background info. I'd be suprised if its not possible to get similar cover in Turkey.
So can anybody confirm whether its standard to have public liability cover within your Turkish insurance policy - I know most policies in the UK have it covered as standard - but not sure about the turkish ones

You also should make them aware if a property is going to be unoccupied for periods of more than one month (even if not a business).
So just to get this straight - Assuming i have liability cover on my Turkish Insurance policy - A guest has an accident - They then have to sue me in the UK as thats where the contract was made?? Or is the contract not really worth the paper in was written on??

They can sue you either in Turkey or the UK.

been through this a bit myself. You can get insurance BUT I think you need a tourism license in Turkey. This costs a load of dosh. The tour companies have the license and the necessary insurance and will book your guests for a fee. I am afraid you are damned if you do and damned if you don't !!!!
If you can get block insurance then you will save money, but if somebody makes a claim on this then there may be an issue where the other owners don't want to pay an increased premium the following year when they haven't claimed.
