I have just returned from Sharm El Shank, I was due to fly from Manchester at 10.30 on 5/11/05 but due to technical problems we fly out at 17.30, in total a 7 hour delay, we were given 8 pounds each to spend and a free drink on the plane.
I believe there is a new EU ruling which I can claim against but I am not sure if it includes charter flights and also as my journey ended outside the EU.
If I can claim does anybody have any advice on how to claim.
Hi Nathan. Last year when we went to Cyprus, we were delayed 5hours at Manchester Airport for our flight out.
the rule is covered in EC261/2004 and you can find information about this on the internet.
The requirement is for either the departure and/or the arrival airport to be within the EEC - so you qualify.
Generally speaking the airline should have provided meals and refreshments in keeping with the length of the delay.
The tour operator also has additional responsibilities under the 1992 Package Tour and Travel Regulations - assuming you had booked a package. Accommodation and flights booked with one tour operator constitutes a PACKAGE in simple terms. Your delay arriving at the destination resort would presumably by about 7 hours. I'm not too certain of your expected arrival time at the resort and your actual - but I'd guess you should have arrived about 8pm but actually arrived about 3am the next day local times.
Talk to Ros Fernihough on 01922 621114 about compensation for lost holiday time.
