As you are a travel lawyer and from your postings I asume that you have considerable experience. Perhaps you can tell me when exactly flight slots are allocated to the airlines ,such as used by Direct. Are brochures correct at the time of printing or are the likes of flight times speculative, and in directs case now as attractive as they can make them look. Subject to change, and clause to cover their backs on just about everything. I booked a package with Direct, flight, hotel and transfers.
As Direct summer `07 are advertising the same early flight as we booked for this year do we assume that the airline has been allocated this slot for next year or would it be fairer all round just to print a brochure with a flight day and time to be arranged.
As the holiday was a package a claim is quite possible, the TO is responsible for the performance of every component part of the whole package it sells.
Afraid all flight timings are considered provisional until the tickets are issued. May be wrong but I think this is under ICAO (International Civil Aviation ) provisions.
