I issued my court claim before the rejection letter came because I had not received a reply. I wait for my day in court.

have contacted watchdog again and am considering legal action.
Can anyone who is taking legal action give me any advice as to how to proceed please. I think there has been a mix up with information passed from the original travel company to the daily express.
I have sent you by PM some information - legal action is now the only option once you get to the final 'not valid' letter stage.
Yes I think there is a good chance the Daily Excess has been stitched up with a lot of duff information provided by you know who. I have seen what was provided regarding myself and it is incomplete and wrong.

I'm trying to get a result for my mum who's coming up 80. She patiently saved her tokens and in October 2004 was told that her cruise would be with Costa Cruises, leaving on 19th February 2005. Did not materialise. Rise Travel wrote to her in 2005 to confirm her name was listed for a cruise in 2006. Dec 2005, Rise Travel wrote to say DE had taken responsiblity but my mum's 3 letters to them (last one recorded delivery) were not answered. Neither did I get anywhere when I tried to help out. No answer, only taped messages on the phone.
You all are obviously in the zone and know what works, but could you please be nice and let me know EXACTLY what I need to do to get my mum her cruise. She is actually 80 next week and it would be great to know that she is lined up for the treat she was so looking forward to.

I don't expect you have time to read all 255 pages, but if you read the last few pages you will see that people have had success either by threatening court action or by actually instigating it. There have been several cruises allocated in the past few weeks.

Just an update: I threatened Legal action and have now been offered (and have booked) a cruise for June 2007.
Just booked my cruise as well for June, did not have to threaten legal action, had my validation letter approx 7 weeks ago and then received 5 cruises to choose from after the letter.
Glad that I hung in there, but it has taken nearly 3 years, but well worth
the wait.
For those that are still waiting, you need a great deal of patience as we all know , I am so looking forward to this holiday having never cruised before.

Excellent news Botoxman! Which ship are you sailing on and which ports will you be visiting? Perhaps you can reply in the main DE topic to save going off topic in this one.
I posted in April about my mum and her attempts to get the cruise she was expecting. She wrote the letter to DE threatening legal action and giving them 14 days to reply. The time is up on Thursday and we are planning the next move.
I had a quick look at money claims on line and have a question for you successful people: you have to direct your claim at one person - who do we name? chief exec or what? any advice very gratefully received! I've said to mum to put some costs together of equivalent cruises/flights to get to the sum asked for. Is that right? again, I would be very grateful for advice for more experienced challengers.

We have been asked not to put specific names on here. Suggest you write to Head of Group Legal Services one more time. Failing that the action is against the MD - you should have his name on your reject correspondence from DE.

I would normally just phone up the company and ask for the name of the Head of the organisation. eg Chairman of whoever. As advised there should be a name on the letter you received.
