Assuming this is a UK agent then you have a good case, especially as you had their written assurance that everything was sorted. No more emails, your next step is a letter sent recorded delivery with a copy of their email and a copy of the receipt for the £40 asking for the money back. And keep the receipt for the recorded delivery, if they don't pay up first time add that to the list!

I'd agree it's up to the travel agent to refund the cost. Did the travel agent also book your flights and inform you of the change to flight times?
