Hi. We have booked the Hotel Ritza in Bulgaria with Airtours and the brochure specifies a jacuzzi in the room.
I have recently received a letter from Airtours, however, stating that there is a change in details and there are no jacuzzis in the standard rooms, but there is a communal jacuzzi (fees payable locally).
I happen to know that the superior rooms have a jacuzzi. Am I within my rights to ask for a free upgrade?
I know this may sound trivial and will not spoil the holiday, but I have a nine year old son who was really excited about the jacuzzi !
Any suggestions please?
Ican't advise you as to your legal rights, but I for one would try and get that upgrade, if the brochure said there were jacuzzis in the rooms. It's surely worth trying

Thanks Kathie, the thing is the hotel has never changed since it was opened in 2001. The standard rooms have no jacuzzi but the superior rooms have. Since they said the room has a jacuzzi I assumed (perhaps nievely) originally that Airtours offered only the better rooms.

Kath, they might try to cover themselves but the 1992 Package Tour and Travel regulations specifically state that the Tour Operator is responsible for the actions of their suppliers.
My best guess, if your confirmation states that your room has a jacuzzi you're laughing. If it doesn't you'll need a copy of the brochure that was in print and active at the time you made your booking. If this clearly states jacuzzi's in the room again your OK. You will need written confirmation of the room type if the brochure says other than jacuzzis in ALL rooms.
Once you've obtained the proof that you purchased a package that included a room with a jacuzzi the removal of this need to be compensated. The easiest way being to grant you the upgrade. The T.O. might say they have no availability of such rooms - this happened with me in Egypt this year when I wanted to voluntarily upgrade. The T.O. said not possible - no rooms available.
I contacted the hotel directly by email and phone and agreed withthem the upgrade fee.
Try the same with your hotel to first establish the extra cost of the upgrade. Then, if the T.O. will not pay this upgrade you should demand that same amount be refunded to you on the basis that you contracted for such in the first instance.
Let us know the outcome.
Oh, the jacuzzi is probably just a whirlpool bath rather than a larger type jacuzzi you get in a leisure centre or outdoors at a hotel. If I'm right they aren't much kop (in my opinion).

Building Work A 4/5 storey block of apts is being constructed approx 100 metres away from the entrance to the Ritza. The hotelier will allocate customers away from the work, however work will be visible on entrance to the hotel and from some of the pool and restaurant areas. They are currently using Cranes/Hand Held Power tools and are working various hours of the day, 7 days a week. Estimated date of completion 31st May 2006.
You could try writing to MyTravel and saying you feel that as the brochure misrepresented the room description that you think they should upgrade you free of charge. It's worth a try.

you cannot ask for a free upgrade because you will find that you have not paid for a jacuzzi room only a standard room and at the time they may have had a jacuzzi in them if they still did have a jacuzzi then the price would be much more that what you are paying just now.
if you got your comfirmation through saying that you have a room with a jacuzzi you can cancel the holiday but you cannot demand something they do not have.
First you say the brochures are correct at time of printing, well if that's the case the room should have a jacuzzi in it as that's what the brochure says.
Then you say she can't get a free upgrade?, how can you upgrade to something you've allready paid for in the first place?, she booked a room with a jacuzzi.
As for the price?, how would anyone booking this know the price was right or wrong for a room with or without a jacuzzi?, the brochure lists the room with one at price A, doesn't say you can have one without for price B or that the jacuzzi is extra at price C
She is not demanding something they do not have, this hotel has rooms with jacuzzis which is why she booked it in the first place, not unreasonable at all to assume that a room described as having a jacuzzi at that hotel would be what you would expect to get.

Seems a bit odd being 'fed-up' with the site when your profile says you joined on 11th July 2006 .i.e. today
As for the jacuzzi I say fight for it! I'm sure it's something to do with trading standards when you are offered product A at product A price and then receive product B at the same price...
