We've recently returned from our honeymoon after staying at the Turkey Holiday Village, Sarigerme.
Our case is as follows. Our family of 5 (2 adults, 3 children, 7,7 and 2) booked a 2 week holiday with 2 Jacuzzi rooms as 1 room wouldn't sleep five, only 4. When we got there, the hotel had asked us why we wanted 2 rooms for our family of 5 and we said that they only slept 4. However, in one of the rooms they had put a "put-up" single bed in one room for our youngest who was 1 on departure, but 2 while we were on holiday meaning there was a Kingsize bed, a double bed and a put-up bed sleeping 5 in total.
Our complaint to FC was that we were effectively charged for a room that we didn't need as the hotel acomodated us al in one room and very easily - it was not cramped at all!
We wrote a lengthy letter explaining the situation, asking for compensation etc...
This was FC's reply.
What do the experts on here think? Do we have a case or have FC covered all bases?

what the letter says is true. The system wont let us book more than 4 into a room like that. We can only book what the system says wll fit in a room. we cant override it and put more in.
The terms and conditions of the brochure state that only four people are
allowed to sleep in a Junior Suite 4 Jacuzzi room, this is for health and safety
reasons. The hotel staff should never have allowed you and your family to sleep in one
room.
The answer is in the above copied from your posting. The size of the room and the fact you chose to sleep 5 in it irrelevant. It is not just H&S but insurance conditions also.

hi, because your child was 1 on departure the hotel may have seen this for a reason to add either a cot or put up bed, but when booking a holiday if a child is 2 on return then we have to book that child as a fare paying passenger and officially has to show that room can take 5 which this hotel didn't, hope this helps
FC will then investigate why the hotel did not allocate you in accordance with their rooming list notification to the hotel. By rights, you should not have accepted the room in the first instance as it was clearly not what you had reserved and this should have been taken up in resort with your representative.
FC should refund you in accordance with their guidelines and the hotel should be severely reprimanded in the best way, by hitting their pocket!
More than likely, the hotel had already sold your room to another family They cannot take reservations from tour operators (of course, charging the TO for the extra room) and then just change the rooming allocation just to suit themselves! The only way to make them understand this, is for FC to deduct the payment from their next invoice payment to the hotel.
