I booked a holiday and was told by 2 staff I did not need a visa for my wife who is a non British national to travel....one being the manager the other being the sales assistant.
The holiday company are saying it is up to me to inquire if we need a visa,I did ask the manager who checked on the internet and told me no,I also have this in black and white.
If I was advised that I my wife did not need one,who else should I believe.

Travel companies are required by a 1992 EU law to tell clients of visa
requirements but we was not told we didnt need one,nor was we told that we should check ourselves after being advised we didn't need one.
Again they are saying it's my responsibility to check if she needed a visa,but if the travel agents don't know who does,I did ask if she needed a visa several times.
We was refused travel because of the visa and the holiday Company are saying tough that's your fault and refusing to rebook the holiday.
This was supposed to be our honeymoon..!
My wife recently had troubles getting back into England taking 4 months so it's not as though I would neglect asking the correct questions regarding the visa.
Any help would be greatly appreciated.

Considering you have it in writing they said you didnt need one, why dont you give Ros Fernihough, Travel Law solicitor a ring, and she will advise you as to your next step.

I suspect that the person who carried out the check did not do a correct search. The best advice has already been given. Contact Ros Fernehough.

7.â€â€Â(1) Before a contract is concluded, the other party to the contract shall provide the intending consumer with the information specified in paragraph (2) below in writing or in some other appropriate form.
(2) The information referred to in paragraph (1) is:â€â€Â
(a) general information about passport and visa requirements which apply to British Citizens who purchase the package in question, including information about the length of time it is likely to take to obtain the appropriate passports and visas; ...............................
As already advised, contact Ros, but a fly in the ointment could be the reference to "British Citizens". Even more reason to seek the advice of Ros.

I am reading so much along these lines...........Bottom line, it is your responsibility to check for any visa requirements - and not the airline.

I asked if I needed a visa and was told NO...! I was not told by the Travel company to inquire to the Mexican embassy.
Again in writing I have this.

My solicitor has emailed them giving them 7 days to reply,again they have not replied once again Thompson showing negligence.

Here on HT we can only give our personal opinions - none have any standing in law. I quote you above, and if that is correct, I would have done more than just ask the travel agent. Agents within the UK are required to give the visa information as it applies to UK citizens. They are not all knowing. In some ways you were lucky. If you had been allowed to board and fly your wife would have been stopped at your destination and then again may have had problems getting back into the UK.
Easy to blame the agent but you are just as responsible. Took me less than a minute to find the information on the internet.

If a tgravel agent had spoken to me like that, I would have walked right out of the shop!
Oh well it's in the hands of the courts.

If I ever said that my feet would not touch the floor. In all jobs I have had in travel I've been expressly told we are not to divulge any commercial/marketing details on threat of disciplinary action.
Why did you not go for Ros' help, OP.. She is no win no fee, she will tell you if you have a good case.
Abusive posts removed - also reference to them in order that this thread reads correctly.
I hope you at least get some of your money refunded for the holiday you lost and at least you will know in future to check matters like visas etc yourself.

The agent is an absolute idiot for stating otherwise, and should simply have removed herself from any responsibility so it was your to check. However, whether legally she is responsible remains to be seen as I can't help think you should have taken greater responsibility for checking for an unusual passport, especially in light of what you went though with UK Visa's.
Also i'm guessing the small print / terms and conditions i'm sure will protect them to a degree, but in the eyes of the law? Look forward to the updates.
