Which holiday company did you book with ?

Did the assistant print this off the internet , as you say you have it in black and white ?

Kath When I returned back to my home town from London I called the holiday travel agent who emailed over as follows.

Manager quote: "Client's wife has a Ukrainian passport have checked on the internet about
passports and visa if the client has a valid passport and return flight
ticket they don't need one."

We was refused travel because of the visa and the holiday Company are saying tough that's your fault and refusing to rebook the holiday


I am assuming you have you lost your money for the holiday then ?

Considering you have it in writing they said you didnt need one, why dont you give Ros Fernihough, Travel Law solicitor a ring, and she will advise you as to your next step.

The internet is a great tool if used correctly. I have just put in "Mexico visa requirements from Ukraine" and it tells you that a visa is required even if resident in the UK. Look Here;

I suspect that the person who carried out the check did not do a correct search. The best advice has already been given. Contact Ros Fernehough.

Travel companies are required by a 1992 EU law to tell clients of visa

Correct -

The Package Travel, Package Holidays and Package Tours Regulations 1992

© Crown Copyright 1992

Information to be provided before contract is concluded
7.—(1) Before a contract is concluded, the other party to the contract shall provide the intending consumer with the information specified in paragraph (2) below in writing or in some other appropriate form.

(2) The information referred to in paragraph (1) is:—

(a) general information about passport and visa requirements which apply to British Citizens who purchase the package in question, including information about the length of time it is likely to take to obtain the appropriate passports and visas; ...............................


As already advised, contact Ros, but a fly in the ointment could be the reference to "British Citizens". Even more reason to seek the advice of Ros.

Thanks for all your support,I will contact the person.

I am reading so much along these lines...........Bottom line, it is your responsibility to check for any visa requirements - and not the airline.

I asked if I needed a visa and was told NO...! I was not told by the Travel company to inquire to the Mexican embassy.

Again in writing I have this.

We are only obliged to give advice only to British Passport holders. In other cases we have to refer to the country's embassy and or consulate.

Thanks for that,I did not receive any information regarding the direction to go for visa was just told to hurry up and book as the lady said she was on commission.

Thanks for all the advice,I am taking my chances taking it to court.
My solicitor has emailed them giving them 7 days to reply,again they have not replied once again Thompson showing negligence.

thanks for ya help,it's already on it's way to court,maybe it's a better idea if you read that being responsible is asking 2 of the travel agents if we needed a visa.

Along with having in black and white managers notes that he was the person who checked and told us no.

My wife recently had troubles getting back into England taking 4 months so it's not as though I would neglect asking the correct questions regarding the visa.


Here on HT we can only give our personal opinions - none have any standing in law. I quote you above, and if that is correct, I would have done more than just ask the travel agent. Agents within the UK are required to give the visa information as it applies to UK citizens. They are not all knowing. In some ways you were lucky. If you had been allowed to board and fly your wife would have been stopped at your destination and then again may have had problems getting back into the UK.

Easy to blame the agent but you are just as responsible. Took me less than a minute to find the information on the internet.

If a tgravel agent had spoken to me like that, I would have walked right out of the shop!

If I ever said that my feet would not touch the floor. In all jobs I have had in travel I've been expressly told we are not to divulge any commercial/marketing details on threat of disciplinary action.

Why did you not go for Ros' help, OP.. She is no win no fee, she will tell you if you have a good case.

Have read your posts and, although I would have personally checked the situation regarding your wife's visa myself, I still feel the travel agent should have to acknowledge some responsibility in giving you inaccurate information - after all, many agents call themselves travel specialists etc and why wouldn't you think that any information they give would not be factual! It also strengthens your case that you have this in writing.
I hope you at least get some of your money refunded for the holiday you lost and at least you will know in future to check matters like visas etc yourself.

Working in travel, I have no doubt that the agent should have quite simply stated "For UK passport holders, you do/don't need a visa = any other passport holders should check with the embassy".

The agent is an absolute idiot for stating otherwise, and should simply have removed herself from any responsibility so it was your to check. However, whether legally she is responsible remains to be seen as I can't help think you should have taken greater responsibility for checking for an unusual passport, especially in light of what you went though with UK Visa's.

Also i'm guessing the small print / terms and conditions i'm sure will protect them to a degree, but in the eyes of the law? Look forward to the updates.
