We recently booked a holiday to Mexico and paid for it before the deadline. The travel agent has just emailed to say the original hotel is now not available, however they will be upgrading us to another hotel in the group. We had already paid to upgrade our room and the change does not appear to be a like for like room. It is smaller for a start.
We do not see the change as being our fault or our requirement and the supposed better hotel is not reflected in the room.
Can we demand a like for like or should we say the contract is broken and demand a full refund and book with another agent.
Any experts on this out there than can advise us?
Package Travel and Linked Travel Arrangements Regulations 2018, if a tour operator makes a significant change to your accommodation, they must:
Under the - give you the choice of accepting the change (with a downward price adjustment if it’s a lesser hotel)
- offer you a refund, with no cancellation fee.
