Hi, I'm (hopefully) flying out to New York on the 25th April for 4 nights. This is all done by my college and so many things have gone wrong its unbelievable!!
1. When a formal letter was given to me I was told i was flying from Manchester Airport (20 mins from me), 3 weeks before the holiday they told me they had just booked it all at Gatwick Airport (4 hours from me)
2. We were confirmed and booked ot stay at Edison hotel near Times Square, I have just recieved a letter now only 13 days before I fly that we are no staying at Regency Inn near Empire State Building which is a dump hotel as I have read many reviews. Downgraded from 3 star hotel to 2 star!
3. That is two things they have changed in the past 3 weeks only weeks before I go.
I dont know if this is pointless to you guys but would you all see this as a dodgy deal from my college. I've had letter after letter saying we've confirmed you hotel then for them to change it.
Should I cancel the trip with them or see what happens? Im scared I'll get there and I'm ending up in a hostel of some sort or they want extra money!!
Advice please
I am sure that if you have paid for a 3 star hotel then they should provide you with the equivilent. If I were you I'd give Ros Fernihough - Travel Law Solicitor she can be contacted on Tel :- 01922 621114. She helps a lot of members here at Holiday Truths and I'm sure she can let you know your rights with regard to this matter.
They ARE a college and NOT a travel agent. Have they acted as the middle man with some local travel agent - if so, you need to speak with that agent and find out what instructions have been passed to the agent by the college.
What do you have by way of written documents from the college. For example, have they put together some "package" and then sold that to the students and does any paperwork clearly state the dep. airport; does it name the hotel (Edison) in this paperwork BEFORE you paid your money ?
Have you paid in full yet ?
Is the college bonded in any way (ABTA, ATOL etc) ?
Have they done this kind of thing before - arrange holidays that is, or indeed, screwed-up previous arrangements ?
Ring Ros and pass her the answers to the questions posed above and she'll advise accordingly; do it soon.
Good Luck,
Mike
It clearly states the hotel on the letter with a back sheet of information on it, they did this solo.
At first they told us they were booking from some travel company then about a month later said they were gonna do it alone?
Thankf or advice guys!!
at the risk of taking flak (from any teachers on this forum), it's my experience that teachers/lecturer's always think they can do everyone else's job better than everyone else.
They should have used a professional tour company.
Not quite sure how that leaves you. The college is acting as a tour operator by putting-together a package (more then one of the following: flight, accommodation, car-hire). Without a licence this is dodgy.
Speak with Ros Fernihough on 01922 621114 for her professional advice. Don't seek the opionion of the college law lecturer ask someone who "does" practice law (not just talk about it).
Mike
Please take Mike`s advice, its spot on......
You might also want to have a word with the Civil Aviation Authority, in London.I think they might be very interested.
Ok thanks for that I probably will because I cant see this holiday goin to plan lol
If it is a study trip, offered as part of your course, they're not necessarily required to have an ATOL licence though it would be worth asking about bonding/insurance arrangements etc if things go pearshaped. In my experience, colleges and and universities take their 'duty of care' very seriously with regards to study trips etc because legally they have far greater obligations to you than any TO or TA would have towards you as a holidaymaker. Your tutors will have had to carry out a full risk assessment etc before getting the OK from their institution to go ahead with this sort of trip.
I am assuming that your college is in Manchester and I would be very surprised if your college was expecting you to make your own way to Gatwick. It would be usual to arrange group travel to the departure airport - mainly so that one can be sure that everybody is there in time for check-in. So, yes, you'll have to leave home earlier than you perhaps planned but do you know why the departure airport was changed? It could be that this is the responsibility of the airline or company the college booked the flights through - even TOs do this as many threads on this forum will testify to. Also, do you know why the hotel booking was changed? Again this could have been done for a number of reasons and might be outwith the control of the college. Compared to some of the horror stories you'll see on this site the changes they are proposing aren't that great.
I would never make any sort of booking for a field trip without ensuring that the students took out appropriate travel insurance either via a group policy sorted out by me or them providing me with proof that one they had taken out themselves provided comparable cover. For that matter I'd never book a private holiday without decent insurance and I'm assuming that you have got insurance too. So you might want to explore what your options are with regard to whether you'll be covered for any cancellation you want to make.
Finally, it's only fair to say that I have now stopped arranging group study trips abroad because they're not worth the hassle. Students these days not only tend to treat them as holidays but expect to be able to behave as they frequently do on holiday. This also meant that it became harder and harder to find reasonable budget hotels that would actually acccept a booking for a student group. More importantly I eventually had my fill of being responsible for students who got drunk and took risks with their own personal safety. The legal 'duty of care' meant that if harm came to them I could be held legally responsible - a young woman from a neighbouring university got attacked whilst returning alone in the early hours of the morning to the hostel she was staying in after a night out and sued the university for not warning her that this was a dangerous thing to do and that they had failed in their 'duty of care' towards her! So I have a great deal of admiration for tutors and teachers in this litigious age who still do arrange study trips etc despite all this.
I am still willing to assist individual students who wish to spend time working or studying abroad by finding them a suitable placement contact etc, usually through another partner university or college, but leave them to sort out their own travel and accommodation etc on the grounds that if they can't do this for themselves then they shouldn't even be thinking about going in the first place :-) Fewer and fewer students are prepared to take on this responsibility and also be responsible for sorting out the financial side as well hence why it is at least 3 years since I even did this.
