Here's the problem in chronological order, sorry if it's a bit long...
24/06/2010 surfed the web looking for good price flight to Bangkok, checked several web sites Opodo, Southall travel, CheapFlights etc. Southall Travel looked cheap so I went part way thru booking to ensure no extra add-ons, backed out before any credit card details were entered .
24/06/2010 eventually, on the phone I booked a return flight with Netflights.com to use EVA Air, paid by credit card £462.72 in total
25/06/2010 Netflights.com took the money from my VISA account.
28/06/2010 (unbeknown to me) Eva Air's automated booking system detects 2 flights same name same flight and sends an Email to both Netflights.com and Southall Travel for confirmation that their particular flight is required (why Southall T.)
30/06/2010 (unbeknown to me) neither Southall Travel nor Netflights.com have responded to Eva Air's confirm flight email by this deadline so Eva Air cancels both flights.
??/07/2010 (not sure of actual date), I telephoned Netflights.com asking for confirmation of flight etc. the guy emailed the documents and also sent the same by 1st class post.
06/07/2010 I contacted Eva to confirm my flights and reserve seats. I was told I was not booked on the either the outbound or the inbound flights because both Netflights.com and Southall Travel did not respond to the confirmation emails.
06/07/2010 Netflights.com now tell me this is my fault for getting Southall Travel to hold the same flight (which I didn't, I only had Web site contact)
06/07/2010 Netflights.com are now saying that they might be able to arrange the return flight for the day after my original return date but that might cost extra, if I refuse they say the only option is to cancel and that would entail a cancellation fee.
As far I see it, it really doesn't matter how many flights I had booked with how many different travel agents, Netflights.com are at fault because they should have responded to the confirmation email sent out by Eva, after all they had taken payment.
Am I within my rights to refuse to pay any extra, demand they sort it out at their cost, failing this inform Visa the payment is in dispute? then book elsewhere.
The answer to the final part of your question depends on how much credit you have on the card, or cash in the bank if it's a debit card. Going through the Visa claim back process may take a couple of months so if you do rebook you'll be out for both tickets until it's sorted.
The airline can't be applying their cancellation fee (which could be quite high) since they already admit they never accepted the reservation so there is only the Netflights service charge that needs to be worried about, the going rate for that ought to be around £30. Have they said how much they want?
The bottom line is that they have taken your money for something which they can't supply. You didn't ask EVA to cancel or Southall to hold a reservation. It begs the question what would happen if 2 people with the same name did try to book the same flight!
