Hi Chazy, just read your posts about logging your complaint in the small claims court. Back in October 2003 we had an awful holiday and came home a week early. We complained to First Choice and like you, we didnt get any satisfaction. They offered us several small amounts of compensation but we felt they were not enough. We took our case to the small claims court like you and just before the case was due to be heard they wrote to us offering us an amount we felt happy with. So hang in there, I believe they leave it till the last minute in hope that all the worry and stress will cause you to pull out.
I wish you all the best with your case.

Thanks for the info There is no fear of me pulling out at all After dealing with the abduction and murder of my niece last year whilst myself and my sister were in Turkey {we had to fly home a week into our holiday after a call from the CID in the UK} and dealing with the Crown Court, the small claims court doesn't worry me at all, if think if anything the Judge would be angry that First Choice would put me and my sis through that Last years holiday was cursed from start to finish
Sorry to go a little off topic there, hope it doesn't upset anyone

Has anyone experienced taking a holiday company to a small claims court? If so, has anyone got examples of how long the process has taken to conclusion?
thanks

Good luck to you Chazy. Anything else to report?
Yes, First Choice have settled out of court, I got the letter today. They are going to pat back £960 this is all thanks to Ross. Don't give up folks, keep at them, I knew we were in the right and with Ros's help we got the compensation we deserved.
love

Many thanks Chazy for coming back and letting us know the outcome. It's most appreciated.

Last year I travelled to Cozumel in Mexico with First Choice and had a fantastic holiday. As a result, I decided to use the company again this year .
I flew to Cuba (Brisas, Guardalavaca resort) had a very disappointing time.
Not only was the resort extremely noisy ( I had specifically asked for a quiet, relaxing holiday), the food poor, concerns with various safety issues at the hotel, unable to swim in the ocean, due to thick sea weed, being awoken early some mornings with maintenance work, beach area work in progress etc etc, But First Choice virtually ignorred me when I logged a complaint.
Also, people on the flight were being told that various duty free items were out of stock , when they were actually sitting on other trollies on the plane! . The crew were balshy too.
I really am not the type pf person to complain, but I felt many points needed to be brought to their attention.
I initially contacted them by email, my first was ignorred and when I contacted again, I had a reply which basically said my comments had been noted and I was not entitled to any compensation.
This REALLy annoyed me, because I had not asked for any compensation, just wanted some answers to the points I had put accross.
I wrote to First Choice, addressing my letter to their MD`s Office....My holiday was in June 2008 , it is now September 2008 and my letter was completely ignored. I reprinted and sent it again and again, I have heard nothing.
First Choice are appauling! when it comes to actual customer service.
This year sent an email to First Choice about a problem with our holiday - sent it in May ---- got a reply in July. To be honest we forgot we had sent it!
Sent another message in July and have not got an answer yet (about a holiday in August).
I know they are busy but you have to laugh ------------- we sent an email to the hotel direct -- The Pioneer in Paphos --- and got a reply within 12 hours each time. Say no more ........
What worries me is that as the smaller companies go bust folk like us (who book flight only are not protected) are forced to book with companies who have the monopoly of the market ad dont seem to care ...........
Best advice I can give anyone complaining is to put it in writing, not email. Also don't give up, ever it pays to be patient
Good luck
chazy
Agree absolutely and send it recorded delivery and this way you can track your letter. Yes and don't give up!
