My wife and I were on the My travel flight to Gatwick on 13th January, which was delayed 24 hours. We had to pay for other flights to Scotland and also for another night in a hotel at Gatwick. The total additional cost was £231.
I contacted My travel soon after our return and asked for them to compensate us. This request was of course refused, and various claims were made e.g. that they were glad their staff at Gatwick had been able to help us. In fact after standing in a queue we were told to go and see BA. Anyway after theatening to take them to court to claim for the additional costs, they agreed to pay, provided I sent them proof of the additional costs. On the phone they advised me to send the originals by post, which I declined to do. I scanned the receipts and sent them by email, receiving an email acknowledging their receipt, and later a phone call thanking me for sending them.
This was in early March and despite this there was no cheque sent to me. I then recieved a letter advising me that the receipts had never been received and that they would not pay up because of this. I then told them that I would go to the Small Claims Court seeking our additional expenses and also one days pay for my wife and I, and that I was now seeking £551. Surprisinlgy the receipts turned up and yeaterday I received a cheque for £231.
The moral of this saga, is that if you have a valid claim, do not give up, the chances of them going to court are very slim, and the most it can cost you will be around £100, in Scotland in any case.
Anyone else get the runaround after this delayed flight?
I am pleased to say I did not. Mind you, our claim was very minor - just extra parking and overnight expenses so under £50. However, they did take a couple of months to pay.
They never turned up at court.The greatest advantage I had was that by taking them to the Small Claims Court, they appear where you live, not as it used to be where they were from, or their office is.
Its a long way to Durham and worse to Scotland. I wish more people would fight these bad holiday firms and take them to Court. The procedures are pretty simple

I agree entirely, the only problem is that in Scotland the maximum you can claim in the Small Claims is £750. You can get around that by each individual person claiming. It is also worth remembering that in Scotland at least you can take them to court up to five years after the event. It is also worth bearing in mind that even if you do lose a case in Scotland at least, the maximum costs awarded against you is only £75. It costs a lot more than this send a solicitor to court, and if they do not turn up you win by default.
