I am sure some of the previously successful litigants will help you there Bao-Lou. Have any of them actrually had to go to court? Basically the Terms and Conditions and your cruise offer are about all you need I would think. Just remember, THEY are defending! Fingers crossed (and everything else) :tup :gluck

yes thats what i think but you know how these people seem to try and squirm theyre way out of things, even suggesting that i sent the papers to the wrong people and that they(de)are not the ones who have to defend the case and the suggestion is that it should be rise or mkm who should be defending i cant wait!!!!!

HELP,I have to post my defence by the 30th of june,I have copies of "cruise" allocation letters, "delay" letters,T and Cs and i am also trying to get a copie of my bank statement to further prove that i even had the £10 debited out of my account,
I was wondering if anyone could help me with anything else that could further "bolster" my claim
any help will be greatley appreciated

You seem to have it pretty much covered. Maybe some other members will think of something you've missed.

If you bank online you may be able to get a copy of your statement that way. If not, the bank is likely to charge you for a duplicate copy. Remember to include that in your claim. ;)

Most banks will charge you £10 for a duplicate bank statement.

Actually, if my memory serves me correctly, I never paid the £10 until I paid for the cruise. I might be dreaming this so perhaps some other 2005 cruisers can help there. Has anyone else been asked to prove they paid the £10?

I've been up to the loft room to look for my documentation I received about my cruise. I received a letter from R*** in October 2004, informing me that I had been allocated a cruise in June 2005. The letter was accompanied with a cruise reservation form that asked for information about passport, dining time / table request,medical declaration, travel insurance details, whether I wanted to 'upgrade' my cabin for a supplement, starting from £399!!. It also asked for credit / debit card details and clearly stated that no payment would be taken until the booking had been confirmed by one of their travel consultants. The payment was made at the point of the telephone offer when they got in touch with me several months later and the cruise ( a different one to the one originally offered) was confirmed.

Hi to baa lou. When I got my offer letter last april(2007) DE waivered the original £l0 charge, so it actually cost nothing, except all the time and patience of a saint. Good luck!

Hello again, fellow cruise-chasers.

Here's an update of my latest position :
I've submitted a Small Claim via moneyonline. Daily Express submitted a defence disputing the amount of the claim and the case was then assigned to a local court. I then received a letter saying that the claim had been 'stayed' to allow time for a settlement to be reached.

What the heck does that mean?! It's stayed until the 19th July. Is there something I should be doing in the mean time? I'd hate to get the claim thrown out now after fighting for so long!

Any advice would be appreciated and, of course, I'll keep you all posted on how things turn out.

Sounds to me like it has been stayed to give you and the DE time to come to a mutually agreed conclusion - i.e. either an actual cruise or monetary compensation. I can't remember having heard of any cases actually getting as far as the court, as the DE seems to prefer to settle first (after keeping claimants in suspense as long as possible in the hope that you will give up - AS IF :roll: ) Don't worry, you will certainly get there, it is just a case of waiting to see who blinks first, and it obviously won't be you!!!
