Hi everybody. I too received my letter validating my cruise at the back end of last year and told to be patient. I wonder how many more years they expect us to be patient?????
So...with a new User Name and a new email address, I'm back!
I sent a letter of intent to start a Small Claims Action to the DE a couple of months ago - a YEAR after my last letter to them which was sent Recorded Delivery and was ignored.
I enclosed copies of previous letters, including the cruise allocation letter.
I've had a letter saying my cruise has been validated and stating that I should hear from them in writing "within the next few months"...
It seems that some letters of validation are now being issued but still no cruises. All this 'please be patient' and 'within the next few months' isn't satisfactory as people have been patient for long enough, and how many is 'a few'? I'm looking forward to hearing the result of the court cases which are now pending. They need a rocket up the backside and a few great big penalties from the courts to help concentrate their minds on the matter now.
I've got my day in court, Monday 21st May in Pontefract.
I noticed on the DE's application they'd requested a hearing in London. I asked for Pontefract, it's gonna cost them a few bob going up and down the country defending all these cases, Leicester in April for Pmad, Skipton in early May for Wallecan and Pontefract in May. they must think it's worth it.

Good news Redo. My heart bleeds for the DE having to go out of London It will be interesting to see if they actually defend the cases or decide to cave in 'without prejudice'. With the numbers already listed, as well as the others no doubt waiting in the wings, the DE lawyers are due to make a fortune and all in what I should imagine will be a lost cause for the paper

Don't Get Done Get Dom is featuring the DE cruise fiasco on Thursday March 29th.
According to my copy of Digiguide, I am pleased to say that the DE has today decided to settle out of Court, by offering me a choice of cruises at zero cost. They have also agreed to pay my Court fees.
I have just booked, for this April, a Thompson Red Sea Magic cruise and have paid extra to include my wife & to get an outside cabin.
I can't quite believe that after all this time it is resolved.
I understand that there are a large number of offers being made today so I do hope everyone on HT who is still waiting will be sorted.
Can I thank those on HT who have given me support and advice. I hope I in turn have been able to help others.

Congratulation Wallecan - having had my cruise in the year promised I can only feel for those left waiting "on the shelf". I'm sure your message will give a lot of hope to those patient souls still waiting for the contract to be honoured.
I hope we will still see you around the forum and I hope that you can write a review of your cruise for us when you get back.

This settling out of court outcome seems very similar to what is happening to those thousands of people who are suing their banks for unfair charges and fees . It appears that big businesses don't want to be named and shamed in the full glare of publicity. Also once there is a judgement against them, then this sets a precedence for all the other cases waiting to come to court.
I think, however, that Trisantona has hit the nail on the head and many more will probably get their cruises now, particularly if they instigate proceedings. The DE will not want to risk being exposed to the full glare of publicity which would inevitably follow a court case.

Is anyone seeking compensation for their "cruise that didn't happen" rather than seeking a cruise now - years later - because their situation has changed and it's no longer as convenient as it was for them to go on a cruise now?
I think it may be we are closing on the point where, eventually, they ARE going to have to settle with the (probably relatively small) minority who haven't given up over the years, AND who followed the T's & C's to the letter AND who kept good records.
I should think that was the expectation and plan all along...wear down as many as possible to minimise the cost then settle with those who are left.
Looking at how many are left actively chasing them, it may well be that they are patting themselves on the back and considering their policy a success...

You are right. The DE have now reached their 'end game' of managing down the potential 30,000 claims to a few hundred. I expect someone is already writing a self congratulatory Closing Off report for the Board.
By their standards they would see this as success, we of course see it for what it is. I think the collective message we would like to give like to leave with all those marketing and sales managers responsible is..........
Congratulations Wallecan - I am sure your cruise will be delightful and I hope now that this has set a precedent for those who have had their 2nd cruise denied. I am not so sure that many others will receive the same result unless that is they pursue the paper like a dog with a bone. I think all of you would be cruisers still have a fight on your hands. Fantastic news, I am so pleased for you. I am sure it is a great relief to finally have your cruise booked. Even when you know you are in the right this whole process is very stressful,and time consuming. I really do hope you and your wife have a wonderful cruise.
I have this week got some quotes from Louis, MSC, and Thomson so I am ready to proceed now. I have been looking for where the post is directing us to the interview with the Director of the marketing company.

I have had a letter from"Dom" and the programme is being aired on the 29th. I hope they keep in the piece about Holidaytruths, I have doubts that the programme will be the big exposee that we would like.
