Vonmac, thanks for your thoughts. Curious how you seemed anxious that by putting a different point of view it might cause an arguement. I do happen to disagree about the T&C being clear, ..... and am also comfortable that we can agree to disagree on this point. Shades of grey (and more especially shades of rainbow colours) are what makes life exciting and fascinating for me. Will be curious as to how a judge percieves it when it comes to court, especially when taken in context of how DE has behaved througout this whole fiasco.

Good to see that you have come back to the forum after an adsence. I think that is what happens for most of us, the motivation to pursue this ebbs and flows as we get on with more important things in our lives. I am curious what the 'payment settlement was?

Hi Everyone

Just Discovered the site, how uplifting! Following the latest round of non action by DE, I was about to give up!!!

I would like to try the MD route can anyone kindly provide an address I could write to?

Does anyone know if there is a system to the allocation of cruises, my original date was May 05. All I have heard since is a letter from DE dated June 05 and informing me I will definately receive a cruise or alternative compensation!

Hi every one, I am a new reader to holiday truths and nice to have people to talk to who are in the same boat as me (excuse the pun!)

I am seriously thinking of taking DE to court as some of you are in the process of doing now.

The question being, How much for? How much can you place on a price of a cruise in a single cabin to the Carribean?

Does one seek to receive a level of compensation to the value of the Cruise, or just the compensation for the inconvienence and expenses acrude so far. With so many phone calls and letters to DE and MKM Promotions, I probably get more chance of getting a response from my dead Grandmother then the DE! :roll:

Good luck to you Marcus in you court case in June. Let us all know how it goes, as I'm sure you will.

1. I seem to recall a posting last year pointing out that SM valued the cruise at £1000, in the Watchdog broadcast, but I can't recall the exact reasoning.

Hi,

It is a while since I last posted here. I am still waiting for my cruise and there is still no sign of it. Letters to them have gone unanswered even letters sent via various consumer programes on my behalf failed to attract a response from them.

I see some are taking legal action against them but this is a non runner for me as I live in Northern Ireland and to take county court action I would have to use the English courts and from previous experience that can only be done if you are resident in England or Wales so those like myself here and probably anyone in Scotland are out on a limb due to the diferences in law.

It is probably a case of continuing to write the regular recorded delivery complaint in the hope that eventually they will cave in.

I still haven't got my cruise & I need a holiday. I'm not going to give up.
Does anyone know if they are doing anything or just hoping the rest of us give up and go away. :evil:

Great to see so many people returning to HT, which just shows how this site has helped. My cruise is now just a distant memory but I'm glad I persevered. It is so tempting just to let it go as there seems no hope at times - but I agree with others who have posted here, this mustn't happen!! One more thing - where is Balcony Phil? He hasnt posted for ages :( :( :(

Hi all, I have noticed that some people have contacted the MD of the DE and have got responses and cruises offered. Could anyone PM me the details of who/where they contacted? I have completed an online complaint to the DE and have sent a letter of which I have had no response.

I will pm you the MD of the DE PDQ by PM!! :lol:

My understanding is that writing to the proprietor still doesn't get a response.... though I am using that as evidence when it comes to court that DE hasn't acted responsibly in sorting this out.

You said that the Cruise Store have offered you a cruise.

As they are the DE's official agent, will refusing the offer not prejudice your legal claim? I realise that it wasn't within the original time frame, but they have given you the chance to have a cruise (and, perhaps, they could say it's of better value than the original would have been).

I'd be interested to see your comments.

Hello, Steve,

I don't think you need worry about the value of the cruise. I would imagine, if you won, that the DE would be forced to give you a cruise pronto, plus compensation for the inconvenience.

I doubt you'd get a cash handout!

The Express legal department wrote to me because the Bedford County Court was incorrectly showing my legal action as still continuing. The Express asked that I serve a notice of discontinuance on the court which I did.

As we were corresponding I asked if the paper that stood for real values would be refunding my £80 court costs. In less than one week a cheque for £80 was received. Credit where credit is due.

Good to hear that you have got your cruise and your legal cost refunded. As you say credit where credit is due. I think you've done the right thing in accepting the cruise and hope you enjoy every minute of it, I know I did and even though I paid more than £10 it was worth every penny.

:wave Hi I'm still here as a watcher and the tanker still comes around at weekends (and sometimes in the week if I'm lucky). So pleased to hear that people are still, EVENTUALLY, getting their cruises. Don't know about credit where credit is due...if DE had responded in a reasonable and professional manner 12 months ago they would certainly have saved themselves all the aggro and bad publicity...much of which may still be to come. Keep on fighting and thoroughly enjoy your cruises when you get them.
And yes,.........where is balcony Phil. I really miss him.
