Thank you all for your advice. I didnt actually know the 'hurricanes' were an excuse!!! I'm determined to get satisfaction one way or another!! Watch this space....and best of luck to everyone else still fighting.

I was another one who was bumped off an allocated Caribbean cruise due to the hurricanes in the dim and distant past. :roll: I finally settled for the Med on the Melody and had a fantastic time but that too seems a long time ago.

Hi Everyone,

Just received a copy of a letter posted to the court from 'The Greatest....' "admitting that I was allocated a cruise but it was over-subscribed," but they "deny that they are in breach of contract and liable for the sum claimed". I take this as a good sign!

I am not so sure, they may be fed up of paying claims and giving away holidays, and now are deciding to use some small print in the Ts and Cs that holidays are "subject to availability". Hmm, need a court case to sort it out. Go for it!

The Express are probably running out of money to pay for the cruises. Don't forget that with the Princess Di 10th anniversary coming up they will want to spend millions on special editions and features, leaving no money for anything else. You've got to get your priorities right old chap ! :D

I don't think the terms and conditions stated subject to availability, that was why this offer has proved such a problem for them.

I have had a look at the T & C's again and the following 2 clauses are the only ones I believe to be relevant:

7. You will be requested to prioritise your months of travel in order of preference. Every effort will be made to allocate one of your preferred dates but there is no guarantee of this. You may be offered alternative destinations and/or dates. You are advised to be flexible in your requirements as many cruises travel only at certain times of the year and particular destinations and dates can have limited liability. All cruises are subject to promotional availability.
18 In the unlikely event of limited availability for the stated offers, all qualifying readers will be offered cruises or flights of equal or greater value to the offers stated.

In my opinion the question of availablity in Clause 7 refers to you, the applicant, accepting their offer of availability

There is another clause which states the offer may be withdrawn at any time but it hasn't been!

has anyone been on Island Escape or Star Med Spirit cruise ? Scicly Naples Florence Toulon Barcelona.
I am going on my Express cruise next Tuesday , and it looks like I'm the only one from HT and I'm travelling alone. I have looked at the excersions and fancy doing some full day ones to make the most of my trip. Etna and Taomina, Pisa and Florence , probably St Tropez, but wondered if there was a coastal train like the one from Villfrance, Barcelona I will do myself on the Metro. If anyone has done any of these trips I would welcome your comments or advice.

Hi to everyone, back from my long awaited cruise, and i have to say it was really nice. Been on the Island Star med discovery visiting Florence, Genoa, Marseille, Barcelona and Vallencia, all nice places altho we didnt do any organized tours we just wondered round and found things we liked to do . I will post a review later in the week as work bekons :( . To those still waiting hope you get your cruises real soon

Hi everyone, Is anyone going on Island Star on 27th Oct cruise(Med Discovery).This is the only cruise date i could manage.Hope to meet some more HT people on there.Really looking forward to it having never cruised before. Hope everyone else concerned gets their long awaited cruise.

I was very excited to receive a letter from the D E this morning which says my 'claim for a cruise has been validated'. It then says'the next step is to prioritise my application for further ivestigation and action it asap'. I can expect to hear 'within the next few months' They 'cannot say when they will next be in touch or confirm what offer they may make in settlement of this claim' It's the last sentence that bothers me. Anyone else had a letter worded like this and then got a cruise later. Oh, and I must be patient while they deal with the backlog of queries.

Hi Maureen,

I wrote to the DE Legal Dept three weeks ago as advised by an earlier poster & today received exactly the same letter as you. Partly it is good in that they "have been able to validate [my] claim" but partly bad as I "can expect to hear from [them] within the next few months". How non-committal is that?!

I've no idea what to do now & will continue reading this forum for advice as I have been doing for the last couple of years.

Just to let you know, I weote to the DE about 2 months ago, after a "3 Year Wait" :x I was going to give them a month to reply, 2 weeks later received a standard letter Which made me very :?
Then 2 weeks later an offer of 4 cruises, I could go like next week, the following week, or the neek after that and then not until october :?
All thouse still waiting, hang in there your turn will come :wink:

Maureen- Keefly. I got my letter last October saying wait a few months, like you i was thinking how long is a few months. It turned out to be 6 months,as i recieved my letter in March with details of different cruises i could choose from. I just got back last friday and it was well worth the wait. Keep your chin up its going to happen.

Like you I had a letter about seven months ago. I decided to e-mail again about ten days ago and asked that the e-mail be passed to the apropriate person. I didn't threaten anything, just asked what was happening as I knew more people were being offered cruises. Presumeably this letter is their response. Now I have been 'validated' I can contemplate legal action. Just wondered if anyone had actually gone to court or not.

Well, it sounds like there's a good chance of hearing from the DE in the short term so I'll sit back for a couple of months then contact them again. Given that I now have a letter confirming for the first time that I definitely have a cruise I suppose I'm pretty content :)

Well I'm finally off on my DE cruise on the Island Escape Tuesday. As my case is already full to bursting, can anyone tell me if the ship supplies towels for use around the pool?
I'm a little nervous about travelling on my own, but I shall make sure I make the most of my trip, and will let you all know how I get on.
