Hi Neil,I seem to be in the same position about to start a small court action, but not knowing the correct way to go about it ,a bit of advice would be helpful, but the info on the thread mostly concerns the ones who have obtained the cruise,may be you could point me in the right direction if you proceed with the court case,mean while i will try marcus , as suggested.regards bucca.
did you write to group legal dept and send them copies of the letters you recieved from them and any proofs of postage ? Did they give reason for turning you down,or was it just their stock letter saying they would not enter into any more correspondence with you?
Forgot the times I written to the legal dept after posting them a copy of an allocation letter received from SR in 2004,and lately have threatened to get even with Don, also an on line court action, still have not heard a dickybird,is the rag still in circulation?,lol,regards.

Following four letters to the Daily Express, the last two addressed to the legal department, i have just received the four page letter from them offering me a choice of five Mediterreanean cruises. I have now booked to go away on October 27th with Discovery/ Island Cruises on board Star. Is anyone else booked to go on this cruise?
Wishing others perseverance to keep going until they have their cruise.

After getting the rejection letter. I wrote back suggesting i might take legal action. Surprise, surprise, i got a letter back three weeks later giving me the option of five cruises. Have i gone for Med Spirit on the Escape Sept 1st 07. Anybody else going.

Am at last back on the net- four months with trying to get TalkTalk line established- what an absolutley lousey customer service they have! am now with Pipex- all sorted in just over 10 days!
Looks like thats at least three of us going on the 27th Oct, we should all meet up for a quick tipple or two!

I am also in the same position. I wrote to the legal dept giving them 14 days to respond before taking legal action enclosing past correspondence. I also gave them a deadline to respond but i have receieved nothing at all.
I am now going through small claims and like you want advice on how i should go about it. There are also other members in my family who applied too but they havent received anything. Should we claim together or individually.
Also is the fee for the on-line small claims court refundeble if the case doesnt go to court.

One last question before I proceed with my court claim. I successfully applied for 02 cruises and received 02 allocation letters. Has anyone else claimed for 02 cruises via the court. My only worry is the following clause:
"There is no limit to the amount of applications per household but strictly one application per envelope, per person/booking".
At the time I read this as I could apply for as many cruises as I liked as long as they were in separate envelopes. Is this the correct interpretation of that clause. I seem to remember another member saying he had had one cruise and went through the courts for the other one but can't find the post to confirm it.

I understand it the same way you do, that each application had to be in a separate envelope so you shouldn't have any problems with that.

Goodness me! Lots of familiar names still abound. Just popped in for a quick look as I'm checking elsewhere for info on Fred Olsen cruise which is cursed with apparent legionnaires. (I am booked on very same ship in 10 days 
) - not a lot of info except as on BBC. FO site doesn't say too much.....(that is Fred Olsen, not Foreign Office 
)

I applied for 2 cruises and have now had them both, I spoke to senior members of marketing at Daily Express and the marketing company Director and both agreed that I could have 2 cruises. I did end up having to wait for the second cruise and managed to get it by giving Group Legal at Express another chance to look at my paperwork and save themselves the £80 court fees. I only sent copies of the paperwork for my outstanding cruise, and recieved an offer of 10 choices with 14 days.
There are a few on the site who have had 2 cruises Marcus see his postings on page 233 and wallecan also lavenderlill and possibly others.
Good luck , my cruises were fantastic and worth the persiverence.

Energyuk - I believe you are perfectly entitled to two cruises providing you applied in separate envelopes. I assume you also received two cruise allocation forms from the original travel agent too and these should back up your claim.
