i will leave a update tomorrow after speaking to ros and instant holidays, not that im holding out much hope !!!

ive just spoken to someone at ros solicitors office and im well pleased as im not only entitled to a full refund as they are in breach of the contract only given me 24 days notice of change of hotel instead of 56 days i can try and claim compensation also if i choose, so now im going to try and find another holiday quickly. going in 3 weeks help !!!!! thanks for all your advise

So pleased I have found this topic - Booked last October to go to the Felez Hotel on the 1st March through Gemstone Travel part of last minute.com. recieved a letter last friday at 4.30pm telling us they had changed the hotel. The hotel given is the Divan Antalya Talya sounds like the same hotel in business area with no indoor pool. Still 5 star but its advertised as a conference centre/ hotel
not the place in my mind for a holiday.
Just phoned the Solicitor given in the ealier posting and they say I should be given a full refund but Gemstone are only offering to refund the hotel cost. Gemstone are saying it was not a package but solicitors have informed me that they booked it for me with hotel,flights and transfer so it is a package.
I dont think at this stage we have any choice but to go (cases are packed) - but waiting for solicitor to phone me back - will keep you all posted

yes it was the divan they suggested, im now having a nightmare, although the person i spoke to at the solicitors have said im entitled to a refund instant holidays are 100% refusing any refund at all and said they have offered me another 5 star and thats within their contract, they have now offered me a 2nd hotel that i found thats a lot cheaper but are refusing to give me a refund of price difference, they are also refusing to give me a holiday break down of the costs even though it was a tailor made holiday they said they booked the package through future travel, im getting very frustrated by this, rang solicitor back and she still saying i can refuse the 5 star they have offered me if im not happy with it but will get ros to ring me back this afternoon, can see im going to have a battle on my hands over this, are you speaking to the ros diane if there are 2 of us might have a stronger case

Yes I am talking to Roz same solicitors.
I am so upset at having the hotel changed like this.
Same as you I checked Hotel out before booking and was really looking forward to our holiday.
I will go to the Hotel Felez and see what is going on.
The travel agent have given me a breakdown of costs but will only refund
198.07 pounds.
Hope you can sort something out soon.

i booked this in oct too, are you going for 1 week, we paid about 675 for both of us flying from birmingham but are refusing to break it down, i have a feeling when i booked flight was around 200 each so room must have been around 200-250 as trans are included and tax on flight. have they changed your return flight time and company too, the dedeman hotel is available at a good price at the moment but they wont refund me the difference, not happy at all, i will also be visiting the falez and taking photo evidence to see if its genuinely closed for refurbishment

rather that speaking by phone you need to put everything in a letter detailing what, also give them a reasonable deadline to compleate this, beacause your phone calls are not recorded you need to help prove evidence in your case if it goes as far as a small claims court, you also need to send this letter by recorded delivery

i know you havent got much time before you are due to travel, but it is an option to think about

Yes we are going for 1 week we paid 640 gbp flying from Gatwick.
The breakdown given to me is as follows

352.00 for flights
198.07 for hotel
16.00 transfers
20.00 booking fee
12.96 credit card charge
61.93 for arranging holiday (this one is a joke)

As I bought this all as a package I had no idea at the time of the high
charges they were making. Have really learnt a lot.
Would like to change hotel but at this late stage a bit worried it they will actually refund even the hotel cost.

pam from solicitors has just rang me ,we are entitled to a refund might might have to fight for it and with solicitors costs not sure whether its worth it going to ring abta later see if i get any joy out of them

im going round and round in circles ive just spoken to abta who have said i cant do anything about the hotel have to accept what evers offered as long as its a 5 star i think that is disgusting but he said because they have shortened my holiday over 9 hours on a 1 week holiday i should have a case for a refund on these grounds, its 12 hours normally but thats on a 14 day holiday , grrr what a nightmare sorting all this out

elle, when i spoke to abta i found they were basicaly covering for holday brokers and not interested in sorting out any problems or even offering advise which would help someone to be able to get assitance.

found them useless too although peter did say i could possibly get refund on holiday due to flight change, anyway due to my investigating im horrified to find out today that my flight hasnt changed at all but the flight is full and they have put on this turkish flight and the holiday was booked in aug not oct when there were flights available so somewhere along the way my seats have been over booked and ive been put on this other flight, im absolutely disgusted by this and now going to ring thomas cook to find out why because instant holidays are blaming thomas cook surprise surprise, i also re rang ros and she said i am definately entitled to a refund due to my room change beign so close to my departure its a mine field of being told different things, but i choose to beleive ros over abta

Going by your experiences I would certainly make sure that I did not book with Instant Holidays. I have written another post where I have praised a company for pulling out all the stops when things were going wrong. They saved my holiday, (and indeed improve upon it!) I would every faith in rebooking with that company.
At least you will have the minor consolation of letting others know how Instant Holidays have dealt with your problems!
