Sorry for the delay in replying but I have just moved house and am at present incomunicardo- awaiting reconnection with internet etc.
I was contacted on Saturday by DE offering an out of court settlement! . They have given me an option of 9 cruises over the next 6 months with flights and a waiver of the costs. They also have agreed to reimburse the costs for taking out the court case in the first place!
I have decided to accept the offer even though the cruises on offer are European based, not Carribean as origanally offered.
It's a result no matter what!
I have booked the cruise with Cruiseline for October and am awaiting written confirmation.
Will keep you informed of any futher progress.
So keep up the pressure and get those applications in! They have obviously realised that the cost of proceeding any futher would outweigh the cost of settling. I must admit I was in two minds as to accept or continue with the case but decided enough was enough.

I've had a letter from DE too and managed to book my cruise today. I flew out to Malaga on Saturday on a mountain bike holiday here http://www.sierracycling.com and it's been a bit tricky trying to sort out dates we could both get off work. I couldn't get time off work to go on the Red Sea cruise so booked today and taking my girlfriend Julia (I know girlfriend sounds a bit funny at my age but never mind she's 5 years younger than me so she's definitly a girl lol) with me for £305 on Thomson Destiny for Oct Coulorful Coasts it's Canary Isles Maderia and Morocco. Always wanted to go to Africa and never been to Canary or Maderia. It's been a long struggle but worth it. There was no mention in my letter about my court fees but I think they will remburse me because Chris and Paul's letter says so. Also paid extra £90 for an outside cabin with a picture window. Flights from Manchester.
I didn't realise I couldn't phone a 0870 number from my mobile in Spain but have and old Laptop with me so managed to get through on Skype, there's an open wireless router nearby it's very handy to be able to check email and ring home for almost nothing, except the 0870 number that took big chunk of credit but I'm not worried cos i got my cruise :-)
Mountain biking is fun but a bit scary when your with a bunch of 30 somthing lads who are almost completly mad :-) Most of them are going home today and tomorrows a day off so hopefully me sciatica will improve no fun this getting old :-) But at least today I kept up with most of them.
I must follow Chris's advice now and read up the reviews of Destiny, to say I'm excited is an understatement

It's obvious from the way this topic has quietened down that many people have just given up, but this proves that persistence pays.

Congratulations to both Paul and Richard. It really is encouraging that things seem to be moving now. This will give so much hope to others who are still in limbo and hopefully give those on the verge of giving up the incentive to make another push.
Well done all to all those who have now secured their cruises. I wish I had been as couragous as you and taken action back in October. I have now got my paperwork and quotes together to start my court case, but have given the DE 14 days notice to reevaluate my claim and make me an offer before I submit it.
Just to let you all know the cruise Iv'e settled for is the Med Discovery on the Island Star. Departing from Palma to Olbia(Sardinia),Civitavavecchia for Rome, La Spezia, Nice, Mahon(Menorca), Palma.
My departure date is Sat 27th Oct returning on 3rd Nov,back just in time for bonfire night!
Iv'e paid a suppliment of £20 to fly from Birmingham and along with my own insurance thats all my costs. So all in all not a bad deal, just goes to show if you stick to your guns things can progress!
I Would like to thank all for the support and assistance in this long running saga and I will still keep informed the end result.

Its going to be on Dont get done get Dom in the morning 9.15am tomorrow - will set video. Says Dom takes on the Daily Express to get Ann her promised cruise - at the end of todays programme he said 'let the battle begin - he does not give up til he gets a result, should be an interesting watch
WOW what a result for some of you..fantastic.i havent checked in for ages but having just seen the BBC dom programme thought i would catch up.. persistance is certainly paying off,and i am sure hearing the results will make more people take court action ..Good luck to all keep at it
I have just watched "Dom" . What a shame Holidaytruths wasn't mentioned, I am glad I got my paperwork off to them at the begining of the week, as I think they may have an thousands of nonvalid cruisers wanting to be reassessed.
Raych - I saw part of it too this morn, but missed the second part of the lady whom was refused cruise due to operation.
Yeah . Iv got my cruise. Had letter offering me 9 itineries and dates etc, just confirmed im going on the Island Star 19th May. I have paid to take my husband. I also would like to thank everyone on here for there input as i wouldnt have known what was going on otherwise. Hopefully all of you will get your cruise in the not to distant future. For those who didn't see the "Dom" programme, he did manage to get the lady her cruise by getting the Group Legal Dept at The Daily Express to re assess her claim.
Oh my god.. i got my letter offering my choice of 9 cruises.. just called that Cruise Shop and waiting for them to call me back.. fingers crossed.. i want the Moorish Delights Cruish with Thomson..
I was also offered 9 cruises and have picked Thomson's Moorish Delights on Destiny on 3rd of May. Can't wait, have decided not to go for drinks package as i intend spending a lot of time of the ship. Thanks to every one for their support, hope you all get your cruises soon!!!!!!!
I got on this cruise, Moorish Delights, leaving on May 3rd, travelling alone.. would be nice to catch up with other people going so don't feel like a 'billy no friends'!

Assume that was not you on the 'Dom' prog today? Actually I think he did a good job, much better than Watchdog.
Looks like the cruise letters are going out - I understood from the CS that they had a list of about 120.
So pleased to see people are getting cruises
